Death penalty does not fit in this instance as there is no declared war.
AWOL does not carry the death penalty in a time of declared war, either. Desertion can.

Has war been declared? There is an Article 15 for sure and maybe some otheres but not desertion in time of war. That'd be a General Courts Martial - I can't see it going that far.

And desertion from command in the field/command with important duty. Doesn't sound like he was planning on coming back.
You can quite certainly be executed for that.
