Congressional Accountability for Judicial Activism Act of 2004 (Introduced
Here's something else I heard on the radio and can't believe it took me forever to find online. I'm so suprised its not being covered by the media at all, well, no, i'm not suprised but here it is:http://thomas.loc.gov/cgi-bin/query/z?c108:h.r.3920:
If this passes, with a 2/3 vote Congress can overturn a Supreme court ruling.

1. The bill

itself will be ruled unconstitutional. Congress cannot give itself judicial power -- it can strip lower federal courts of jurisdiction, but the Legislative does not have the power to rule on constitutionality issues -- The Supreme Court is established in our Constitution just for this reason.

If this passes, the law itself will be challenged. It's a poor attempt to politicize the judicial arena. Sickening...

It will turn Constitutional challenges into political debates on the house and senate floors. Congressmen do not have the broad knowledge to rule on such sensitive issues thus relying on advisors, etc.

They need to realize that an unfavorable ruling does not equate to judicial activism. They are just whining.

2. While this bill is a political ploy in an election year....
what's scary is that there are a significant number of members of the House that are passionate about giving COngress this power.
