We've been mocked for years for being scared of what the Repugs would do with open seats on the court. How's it feeeeel, pubbies?

Rehnquist, Stevens, O'Connor, and Scalia (Scalia's not exactly a spring chicken).

None of them are spring chickens, if you look at their ages.

For instance, Clarence Thomas is the same age as a beloved African American professor I had who dropped dead of a heart attack without warning.

31. Scalia is only 68...
and Supreme Court Justices seem to have very long life expectancies. Then again he is something of a pudge ball, so maybe we'll get lucky. :evilgrin:

Kerry will most likely get to choose a new Chief Justice, and I deeply hope he chooses wisely. The Court needs a strong personality with a more progressive mind to lead it.

15. WHOEVER IS THE NEXT PRESIDENT WILL HAVE THE OPPORTUNITY
....to appoint atleast 2-3, possibly 4 justices. Even one will alter votes such as Roe v. Wade and other important laws and judicial decisions, so this election is about saving the last of the "Checks and Balances" on our Constitution and of the other Branches of Gov't.

If Bu$h/FUCheney are running this country for another 4 years, the United States of America will fall. If Kerry/Edwards win, we have a chance of saving it. Doesn't get much more simplified than that. For this one single reason listed in my Subject line, the point of this thread, is that EVERYONE who cares about this country and our Constitution needs to vote for that reason alone.

because of the damage that can be done to our country by fundies and rightwingers getting a stronghold over every Supreme Court decision coming up--another 4 years of Bush would assure that.

Whoever is the next President will be responsible for appointing key judges with lifetime seats to courts that will decide important decisions as well...

4 Justices appointed by Bush- you can kiss goodbye to not only Roe v. Wade, but also Griswold v. Connecticut... Which means any "right to privacy" established in that ruling that said married people (gasp!) have the right to use birth control would be gone.. a long-time wet dream of the religious right. Also, you can wave goodbye to any sort of environmental protection, at all.. We will spend the last, increasingly overheated years of our lives in a country that is, essentially, one giant parking lot in between intermittent starbucks and wal-marts. Freedom? Hell, corporations will be free to do whatever they want.. you, citizen, better watch your ass. That's about all you'll be able to watch, because your right to watch, read, write, and say what you want will be severely curtailed for "security" reasons, not to mention good old fashioned puritan censorship from the likes of Pat Robertson and James Dobson. The rest of the bill of rights will be rendered completely null and void (as opposed to just effectively null and void, as it is today) with the notable exception of the second amendment, of course.

Nader people should think very carefully about the long (several decades hence) term implications of screwing up another election.

I still can't even imagine what anyone voting for Nader this time would be thinking....and I can say that since I voted for Nader in 2000....although be it in CA, which I felt was safe, but my Mom was in Florida and voted for Nader and can't forgive herself....not this time....

If he sees there's no chance for him to become the Chief. Go private and make zillions. I have actually heard it rumored by Court-watchers, that Scalia is less than ecstatic with things there.

Ginsburg and Stevens already lean left; O'Connor has been remarkably centrist but could be replaced -- possibly -- with a liberal; replacing Rehnquist with a trained monkey would be an improvement. So we'd see a net pickup of two justices. Three, if the rumors about Fat Tony are correct.

22. I've been screaming this for years..
At this point, the average time served on the Supreme Court bench is a bit over 17 years. So we'd not only in effect be voting for president; assuming that the winner in November gets at least 2 appointments, we're voting for those 34 years of decision-making also.

Even if you don't like Kerry, you have to consider this piece of the puzzle. Imagine gaining control of Congress back from the GOP.. only to have our lovely liberal legislation knocked-down by a Scalia court. If Bush were to pick wisely, he could have a grip on the court for the next 25 years..

Kennedy has been a recent RW monkey in hopes that he would get job, but with the election fiasco, O'Conner and Rehnquist didn't want to quit and have that as a legacy, so Kennedy got punked (I think the monkey would have picked 'Tony personnally imo). Also, if there is a repeat election fiasco, does the SC, which has endured a searing credibility problem because of the last one, do they wade into the shit again, or this time, stay above the fray to salvage what remaining reputation they have???

Unfortunately, the GOP stopped many Clinton Federal appointments, and Bush has packed several idealogues into the lower courts, but if the SC is tilted back to the left, the damage could be mitigated.

I suspect that Christians will become a persecuted minority in this country. The debates we may have in our courts, will not be on Bible reading in schools, but on whether teaching Das Kapital will be required in schools.
Christians will be demanding the separation of Marx and state. I wonder what position Barry Lynn of Americans United for the Separation of Church and State will be, during that debate.

Possible court rulings of a Kerry Court. Gay marriage will be made legal in all states, using the 1967 Loving v. Virginia as a precedent, as Andrew Sullivan has so often argued. Prostitution will be legalized in all 50 states, in the name of "privacy". State laws restricting abortion will be declared null and void. America may also follow the British example, and make 16 the age of consent for sexual intercourse for all states. The right to gun ownership will be restricted in all states, following the British and Australian models.


What ever happened to this 'small government' philosopy that conservatives used to scream about?

Better yet, what is their definition of 'small government'?
