House Votes To Tie Judges' Hands In Gay Marriage Cases
(Washington) The US House of Representatives Thursday afternoon passed the Marriage Protection Act tying the hands of federal judges from ordering states to recognize gay marriages sanctioned by other states.

The measure passed the Republican controlled House by a 233-194 vote.

Federal judges ``must not be allowed to rewrite marriage policy for the states,'' Rep. Sue Myrick, R-N.C., said.

"Marriage is under attack,'' said Rep. James Sensenbrenner, R-Wis., referring to the Massachusetts state court decision allowing same-sex marriages. The legislation is needed, Sensenbrenner said, to prevent Massachusetts law from being applied nationwide.

2. If something is unconstituional, Congress passing a law saying
that the federal courts can't consider it's Constitutionality doesn't stop the courts.

Otherwise, Congress could pass a law saying "no one can crticize Bush and the federal courts can't hear challenges that this law violates the First Amendment," and then the courts wouldn't.

7. If the Supreme Court rules that their little law is unconstitutional
then it cannot stand.

The legislative branch can't tie the hands of the judicial branch--particularly if the US Supreme Court smacks it down.

If so, then the legislature would always pass laws that had as a rider that the judiciary (the courts) couldn't overturn the law.

Sounds like the legislative branch doesn't know that its power is limited.

9. I phoned my con-man about this today
and told him it was unconstitutional. Knowing the repuke, his aide didn't bother to record it-I'll get a crowing letter about how this dipstick has 'saved' marriage.....

Maybe tomorrow I'll phone with a plan to really 'save' marriage:

1. Ban all divorces.

2. Make affairs illegal.

3. Make living together illegal.

4. And while we're at it, let's imprison all illegitamte children, as they are obviously a 'threat to marriage'.

If I play it serious, do you suppose the dope will think I really mean it?

10. Complex Constitutional issue but has no chance in Senate
There is an argument that has never been tested that Congress has the right to take jurisdiction on certain issues from the lower Federal Courts. The Constitution only provides for the US Supreme Court and allows Congress to establish the lesser courts. Some has argued that this means that Congress can limit the jurisdiction of the lesser Federal Courts and provide that these courts do not have jurisdiction over such matters as gay marriage or abortion. This theory has never been tested.

The key thing is that this law has no chance whatsoever in the Senate. It will be filibustered and it will be inter sting to see how many votes that Frist can muster this time around. Last time Frist and the GOP could not muster up a simple majority much less the amount to stop a filibuster.

11. Someone wrote a letter
to the editor of my local paper saying that gay marriage is spiritual terrorism, then wrote absolutely nothing to justify that claim.

To my knowledge, no gay married people have ever attempted to blow anyone up, or flown airplanes in to towers, but hey, whatever. I keep picturing two guys with bouquets and uzis...... Seems like anytime the RW doesn't like something or someone, they accuse them of being terrorists.

I really, extremely dislike Sue Myrick. She is my rep, much to my dismay. She is nothing better than a rubber stamp for Bush. Also a huge hypocrite. She was all over Clinton for the Lewinsky thing, while conveniently forgetting that her husband was married to someone else when she first met him.

they have a 911 report that needs action...and they are f...cking....talking about marriage.....they cheat on their wives...they beat their children....beat their wives....and they are worried because some gay people want rights and protections under our law.....

these ass.......holes....only protect themselves...with their raises every november and FULLLLLLLL medical coverage......they have ticked me off today....big time......

throw them all out of office.....ever last one of these idiots...

13. National security is taking a back seat to this?
Uh, they're not going to have many marriages to protect in this country if those idiots don't bestir their lazy asses and start doing some long-term planning and work on our national and international security situation. Little things like not ALIENATING THE HELL out of our allies would be a nice start -- that and not unilaterally withdrawing from treaties.

It was interesting to hear some of the press conferences today after the release of the 9/11 report. There were some sensible comments and bipartisan approaches -- and then there was the dumb-ass House leadership, who got up and proclaimed all the wonderful things Saint George had done to protect us, and how bad things were in the '90s, when that evil Clinton boy was in charge. :puke:

Well, their little Iraq war didn't make us safe, which should be apparent to all, and they're so busy patting themselves on the back, they wouldn't notice if the cloakroom was filled with al Qaeda operatives. We need a new Congress, now.
