a black student who asked a question about racial profiling.

The Kennedy School student, Larry Harris Jr., said that his Fourth and 14th Amendment rights had been violated when he was pulled over in Cambridge for—as he put it—“driving while black.”

Scalia was less convinced.

“What the Fourth Amendment prohibits is ‘unnecessary’ search and seizure,” the justice said. “Is it racial profiling prohibited by the Fourth Amendment for the police to go looking for a white man with blue eyes? Do you want to stop little old ladies with tennis shoes?”

The eccentric justice launched into a parody of a police radio dispatch under a scenario in which profiling were prohibited. “The suspect is 5’10, we know what he looks like, but we can’t tell you,” Scalia quipped—drawing laughter from the audience.

Harris was less amused. He said afterwards that “the flippancy with which dealt with the question was insensitive. It shows that on issues like this, he might be a little out of touch.”

or is he just a complete fucking asshole? "Eccentric" — we don't need "eccentric" people like him making life and death decisions for our country.

5. "eccentric" is some guy trying to build a perpetual motion machine
out of old tin cans in his spare time. I think the term they were looking for was "arrogant asshole".

The 4th Amendment doesn't mention unnecessary search and seizure, it mentions unreasonable search and seizure.

I can't believe that I know more about the U.S. Constitution than that fat racist fuck.

... is the totally specious notion that the police are focused on some single, isolated, and recent suspect. This is total hogwash. The invention of some single fictional suspect to rationalize a DWB stop is without any kind of grounding in reality. At any point in time, the police have a plethora of individuals, of all colors, ages, and even genders that they're seeking. But every time the fascist right-wing rationalizes a police stop, they pretend the police are only looking for one (conveniently black, of course) person.

This is outright deceit. It betrays a confabulation in support of deep-seated bigotry.
