20. She knows her life is threatened and that of her family.
If need be she will go to jail but it won't be because she is so loyal to her source. It means the source if really high on the chain of command.

I don't much like Judith Milller but I believe the source shield laws are important if we ever get a free press back in this country.

Unfortuatly we have a congress with a majority who could care less about the security of our country.

I sincerely hope when Kerry is elected he will flex his prosecutorial abilities and clean house on the former administration and bring charges against the conspiritors in both this administration and the congress.

11. I Think The Shield Law Should Apply
When whistle blowers are trying to reveal government wrongdoing but not, as in this case, when reporters are suspected of being complicit in crimes. What they are after with this set of phone records, I believe, is whether she and another reporter, Shenon, tipped off an Islamic charity to a forthcoming FBI raid.

12. That is right.
There are two investigations involving Miller. Both are being run by Patrick Fitzgerald. The phone records which were recently requested have to do with the belief that Miller tipped off an Islamic charity that the FBI was coming to visit. This has nothing to do with freedom of the press, or confidentiality. For Miller to try to hide her criminal behavior behind her status as a reporter is as obnoxious as a priest trying to hide abuse as being a confidential relationship.

18. There's huge difference between reporting CRIMINAL behavior
... and being an ACCOMPLICE in that criminal behavior!

I'd be willing to be a human shield to protect any reporter who'd report, based on information from a 'source,' WHO IT WAS that broke the law and exposed a covert intelligence operative. I'll be damned if I'm willing to protect an accomplice to such criminality.

13. Why hasn't Novak been indicted for obstruction of justice ?
I know some of you are more knowledgeable regarding legal matters than I am, but if Novak is called before the Grand Jury, and asked to reveal his source, and he refuses, shouldn't he be indicted?

14. First, we're not sure
if he's been called to testify yet. Neither side will comment. It's likely that he will be the last reporter that Fitzgerald called.

Let's suppose he is called, and refuses to appear. Then the judge can put him in jail. But he would likely be given the opportunity to appeal, and the case could be stretched out.

Novak could also appear, and refuse to answer questions that deal with the specific incident of the leak. While that sounds unlikely, Novak is an odd fellow. He'd likely be jailed for this.

Novak is certainly an obnoxious character. I suspect that being Bob Novak is some form of karmic dues. But he is not the most important target in the case. The most vile of the criminals involved in the Plame case will be debating John Edwards next Tuesday.
