Any Business Law Types Here? |
|
I would very much appreciate a little advice.
I just got out of a committee meeting with some bigwigs of labor (names withheld); discussing a problem that a small sister union (only 16 members) who are getting killed by another union who crossed their picket lines. The main problem with this other union is not the membership itself, but rather their leadership. It has been brought to my attention that three of their officers are ALSO members of a Mangers Association (names withheld).
My question is this: Although there is no direct conflict per-se, there is never the less a conflict. And what would be the best area of law for me to research.
Due to an overwhelming amount of work being put into this election. I am the one they felt best to drop this onto this morning. And any help would be greatly appreciated.
Thanks..

1. You might try research in federal labor law. |
|
Assuming that you are not dealing in transportation (airlines or rail are governed by the Railway Labor Act), you would be looking at Title 29, Chapter 5--Labor Disputes, Chapter 6--Federal Court Jurisdiction, or Chapter 7--Labor Management Relations.
You might try your state statutes as well.
Also, if both unions are AFL-CIO, then there are probably internal rules governing territorial disputes.
Good luck.

Amandabeech, thank you for your help.. I'll go read that section. At least its good to know that I am looking in a good area.. I just got finished with researching U.S. Code Title 29 - Chapter 11 - Subchapter 6 - Section 501.
Again, thanks Amandabeech

But I would read the organizations constitution and by laws to see if the "managers" are allowed to even be members of the union.
