BBV: Our position is that fraud took place.
Help America Audit

Our organization has taken the position that fraud took place in the 2004 election through electronic voting machines. We base this on hard evidence, documents obtained in public records requests, inside information, and other data indicative of manipulation of electronic voting systems. What we do not know is the specific scope of the fraud.

We are working now to compile the proof, based not on soft evidence -- red flags, exit polls -- but core documents obtained by Black Box Voting in the most massive Freedom of Information action in history.

We need: Lawyers to enforce public records laws. Some counties have already notified us that they plan to stonewall by delaying delivery of the records. We need citizen volunteers for a number of specific actions. We need computer security professionals willing to GO PUBLIC with formal opinions on the evidence we provide, whether or not it involves DMCA complications. We need funds to pay for copies of the evidence.

There are certainly indications that a sting, or at least an investigation, is in play right now.

Strong indications that both Florida and Ohio would be flipped if election manipulations are rolled back. Some indication that fraud may have occurred in at least 30 states.

It's okay to use the "F" word. Fraud. You can say it in public. Pretty soon, they'll be saying it on TV. If no one else does it first, I'll be saying the "F" word on TV shortly.

Fraud.

Use the word.

thinks it's odd that the exit polls and the election results not matching is odd. Of course, he thinks it's the polls that are wrong.

3. I'm dumbfounded to think that OH and FL

and a public face on this again.

To me, the fraud occurring or not occurring in this election is now moot as far as any practical consideration for us and the results we now have to live with.

HOWEVER, if we can somehow go toward proving fraud or drawing enough lines toward fraud having occurred, it will bolster the arguments we have been promoting the last few days that WE WILL NOT REST until we have voter verified voting machines EVERYWHERE with a paper receipt and some type of external cross-check algorithm that can be run at any time for reconciliation.

I thank you and will join you in this quest. We got their attention. NOw we need to get their action. SOMEHOW we need to shake the rafters and get our elected officials to put together AIR TIGHT legislation for us. And there should be a roadmap for even better and more uniform, streamline voting on a national scale with OPEN SOURCE CODE!!!

24. actually, the Constitution Says Nothing About "Concessions"
If it is proven that Kerry got more votes in Ohio or Florida before
the EC does its thing, those votes *could* be awarded to Kerry.

Either state will do, we're not picky.

If that *did* happen, then say hello President-Elect Kerry :party:

It is contained in David Boies book, which I am currently reading. He discusses in the Bush v. Gore portion the fact that Jim Baker threatened in 2000 to have the Florida legislature select a slate of electors should the recount by won by Gore. The Florida legislature would pick a Republican slate regardless.

On the day the Congress selects as "Election Day" -- this presidential election year, November 2 -- it is required by the Constitution that not only the people vote but that the slate of electors be chosen also. That slate of electors is determined by the state constitution. All state constitutions delegate that selection to the outcome of the popular vote (except Maine).

A state legislature can change the way the slate is selected only if it does that BEFORE the election. It is unconstitutional to change it AFTER the election. When Jim Baker looked into the television cameras and made that statement, he, as an attorney knew it was unconstitutional. Most of us, not being attorneys or Constitutional experts, did not know this. Because of David Boies book, we now do. Let them threaten that this time. We know how to fight it.

Thank you, David Boies. I do not think it is a coincidence he published his book AT THIS TIME. IT WAS JUST RELEASED ABOUT A WEEK AGO. I WOULD NOT HAVE KNOWN THIS HAD I NOT READ THAT PORTION FIRST. He's a damn smart person.

10. I have followed the numerous and acrimonious threads...
...that have resulted of late whenever Bev Harris posts, and I would respectfully ask that everyone set aside their personal issues and their personal histories with Ms. Harris and the others who've been fighting among themselves almost as fervently as they've been fighting the fascists. If Bev Harris is right, she and her associates have an opportunity to strike an historic blow for democracy. If she's wrong, then we'll all know the truth.

In the meantime, let's all do whatever we can to support her efforts. I don't have any of the specific qualifications you need, Bev, but I can say the F word, and I don't currently know anyone better qualified than you to invoke it.

My bet is that we'll see the lawyers we've been hearing about coming forward shortly. Outstanding work by Kathy Dopp, if you haven't seen it yet. This work alone cries for a paper ballot audit of the optical scan counties in Florida.

Serious anomalies with central tabulators are showing up, in dozens of Florida counties.

The ludicrous flaw of the day is, of course, the Broward central tabulator that counted backwards.

This is an effort of many talented organizations. It would be a mistake to assume that the coming meltdown was caused only by Black Box Voting, though I must admit that we do kick ass. What you're going to see is the result of we, the people, collectively mobilizing to take back our vote.

Here's another thing, while you're letting the word "fraud" roll off your tongue: We do not have to accept a fraudulent election. Drop the idea that it's too late to correct this mess. We have a great country, and it is in our nature to roll up our sleeves and tackle tough challenges. We must not shy away from that now, in this critical time.

we've heard this before and yet BBV continues to languish in the realm of "conspiracy theory" for a big portion of the public, the media, and the politicians.
I don't believe this because I've seen the opinions of the scientists. But this is going to have to be something so incredibly undeniable and earth-shattering that NO ONE will be able to deny it.

I can't wait to hear this in the media. They've all reverted to the foolishness that the exit polls must have been flawed. and stopped there. I look foward to helping further any and all efforts to uncover and remedy the fraud in this election.

people how important this is. We know. But, it's even more important in light of Bush's horrible comments after the election. The threats against the Dems, the "with us or against us" mentality, the "mandate" for his programs (which he didn't even talk about during the campaign) he is trying to claim. 39. Bev, the clock is ticking. We have until December 13th to raise hell.
On December 13th, the electors convene in each state capitol to officially record their votes for President.

If the veil of legitimacy isn't pierced by then, it may be too late.

Can you use this deadline to gain expedited hearings in the courts, if needed? Otherwise, GOP officials will just continue to stonewall and obstruct at every turn to run out the clock.

December 13th. We have 5 weeks to save our democracy.

53. What I think and what we can prove are not quite the same
I think the mechanisms were in place to steal at least 20 million votes.

Documentation, in the form of internal machine audits and copies of polling place tapes, along with other kinds of data like documents that the number of votes cast exceeded the number of registered voters by very significant amounts, along with documentation that indicates remote access security features were disabled for the specific systems that counted around 40 million votes (number is mushy as we are pulling in the docs showing who used modems and who pulled the plug on them) -- well, this documentation is proof...of something.

We don't have a shortcut at the moment, and need to keep collecting those documents as they come in. We've ordered about 100,000 pages and have two more nationwide, 3,000-jurisdiction Freedom of Information actions to go. (You can request only documents that already exist, which means all documents that are created in connection with the canvass had to be requested after they exist).

We are also doing specific follow-up FOIAs customized for the anomalies. I hope to have some of those on the Black Box Voting (.ORG) this weekend. It's been pretty crazy, and you absolutely can't imagine how much new evidence is pouring in.

I'll post more as we get a chance.

108. Stealing big may be safer than stealing small
Just stealing enough votes to win by a few thousand invites recounts and other scrutiny. It turns out that it is better to go all out and win by margins that seem insurmountable.

Did that happen? I don't know and I hope not, but I sure as hell want to find out.

Flordia ballots show huge (and I mean HUGE) numbers of DEMS supposedly voting for Bush in very Dem counties. That is indicative of wholesale theft of this election! My partner spent hours crunching numbers last night and there is no doubt - they stole FL and they probably stole Ohio as well. Trust me, we are NOT the conspiracy theorist types, and even on Wed I posting here saying "take off the tin foil hat" to people who automatically assumed it was stolen.

But it was. It really was. Check here.

It's just not possible that 40 and 50% of registered dems voted for Bush, but ONLY in optical scan counties.

I don't know how to post a spreadsheet here, but here is a summary of how they did Florida:

Summary

-- In 13 of 15 touchscreen voting counties in Florida, Dems gained over what would be expected looking at just registration percentages –more than just Dems voted for Kerry in these counties

-- But in only 7 of 52 optical scanner voting counties (15%), Dems gained over what would be expected looking at registration percentages - this seems a little odd

-- In the touchscreen counties, the average gain was 8% over what you would expect based on Dem registration, including all 15 counties

--In the optical scanner counties, the average loss was 16.6% under what you would expect based on dem registration, including all 52 counties

-- If you apply the 8% average plus the expectations based on registration that was seen in the touchscreen counties to the optical scanner counties where we saw losses in the Dem column, it's a total of 281,143.

If you add this number to Kerry’s total, and subtract this number from Bush’s…

Call me a tin foil hatter, I don't care, I absolutely without question believe this election was defrauded. (BTW, my latest donation went to BBV two days ago.)

The caution I ask for, however, is this: Before we go "too" public with this we must have our ducks in a row. We have to have undeniable facts or they will shoot us down as quickly as Dan Rather and we will never be able to make the case again. Donations are needed but if you can't do that, then sign up as part of the clean up crew and help finish getting contact information into the state forums for each county.

This is time consuming especially if you are on dial up but it needs to be done.

Maybe Bev can post the states and/or counties that are stonewalling so people in those states can demand the requests are fullfilled- or go in person and demand the documents for themselves.

If you are a computer scientist willing to step forward about the concerns, volunteer.

If you are a lawyer, step forward and volunteer. There were lawyers coming of out of the woodwork for the Kerry/Edwards campaign. Well, it's not over and your help is needed to validate your previous efforts. Strike a note for democracy and volunteer to help Blackboxvoting now!

Legitimacy is a powerfull thing and too many people know too well that nothing was legitimate about this election.

In the past, networks were always using exit polls to make calls on who won, and they would be racing each other to see who could be the first to call a state. Yet I don't ever remember a call being reversed.

But now the exit polls are always supposedly wrong since the repugs have their BBV. Yeah, right.

Hi All,

Like most here, I have anguished over the election and the possibility of election fraud. This is made more real, personally, since I observed the ES&S touchscreen machines err in Dallas, TX.

So, instead of using much of our valuable energy fighting for existing election machine changes, I suggest that we short circuit the problem by leading an effort to design and produce an Open Source voting system. This is easier than it sounds and can leverage the vast technical resources at DU and elsewhere. One has only to look at all the successful software developed for LINUX.

Using an Open Source model we can build an election system that is open and transparent to all scrutiny. The end-game would be the gift or sale of the technology to all counties, cities, and sates at no more than cost. If managed properly, we could undermine the existing corrupt e-voting companies and enable fairer voting by cash strapped governments. Eventually voters would demand their votes be counted on trustworthy equipment.

Since I have not the resources of a Soros, I can volunteer only time and skill. To that end, I now volunteer to coordinate this effort and look forward to hearing from all similarly motivated individuals. I also suggest that Skinner and company consider setting up some forum space which will enable the initial and continuing dialog on this effort.

Working together we can lick this problem and lick the Repubs at their own game.

"What we found was implausible enough to justify an investigation by law enforcement authorities. Precinct level information from 11 northern counties revealed that two parameters which can be logically connected to electoral fraud (ballot spoilage and the number of Gore votes divided by the number of Nelson votes) account for two-thirds of the variation in Gore's performance; the chances of this happening by chance are about 1 in 1047 (10 raised to the 47th power). This was true in aggregate as well as individually. Each of the eleven northern counties that we studied had patterns consistent with cheating by Republicans. These were Bay, Bradford, Calhoun, Columbia, Dixie, Gulf, Hamilton, Jackson, Suwanee, Union, and Washington. Precincts in some counties had discard rates of up to 40 percent of ballots cast! Calhoun and Dixie showed profiles possibly suggestive of ballot box stuffing. We suggest that the most consistent explanation of the statistical anomalies is a pattern of criminal tampering with ballots, primarily (but not necessarily exclusively) by Republicans. In just 14 suspicious precincts with suspiciously high ballot discard rates, 844 ballots for Gore were destroyed in excess of what would be expected. In the 11 counties, the total number of Gore ballots involved is probably in the tens of thousands, our model suggests that 7,100 votes may have been destroyed, so the number destroyed in all northern counties may have been many tens of thousands." Board awaits state followup

WAPAKONETA -- Auglaize County Board of Election members say they have not heard any more from the state regarding a possible investigation after receiving notice of being placed on administrative oversight last week.

In a letter dated Oct. 21, Ken Nuss, former deputy director of the Auglaize County Board of Elections, claimed that Joe McGinnis, a former employee of Election Systems and Software (ES&S), the company that provides the voting system in Auglaize County, was on the main computer that is used to create the ballot and compile election results, which would go against election protocol. Nuss claimed in the letter that McGinnis was allowed to use the computer the weekend of Oct. 16.

Nuss, who resigned from his job Oct. 21 after being suspended for a day, was responsible for overseeing the computerized programming of election software, according to his job description. His resignation is effective Nov. 11.

124. Some things to do

A few thoughts:

I hear that the folks at http://www.electoral-vote.com would be interested in getting serious-type data suggesting voting fraud. Their site isn't widely circulated I guess, but they are taken seriously by those looking at the subject(?)

Some good other sites for all this: www.eop.blogspot.com, http://ustogether.org/Florida_Election.htm, www.bluelemur.com/index.php?p=388, and articles at tompaine.com, truthout.org, and commondreams.org. There were some really good discussions in the liberal blogs.

BBV needs 50k to do an effective investigation. It's been suggested elsewhere that George Soros could put up the money. Yes, lots of people could. It would be a nice dig for it to come from Michael Moore or et al. Off the wall stuff: the traders who put bets on Kerry at tradesports.com would be pissed to think they were defrauded of big bucks - they would help!

Another thread says that some congressfolk already know about it and have requested a GAO investigation (but hard to get through Republican stonewalling.)

Talk to the pollsters like Zogby who want relief from the charge that their exit polls were wrong. There was a WaPo story, 11/4 I think, about an Exit Poll Director who said "We were right." Many of those guys are baffled at why their results were "wrong", and might be amenable to the idea that the voting machines were wrong instead! However, we must rule out mundane explanations such as Bush voters more likely to vote later, etc.

Finally: remember that bloggers brought down Trent Lott.

126. Writing the major US papers
I have been writing the major US papers telling them about you, Bev...LA Times, NYT, SF Chronicle...and so on. I am very good about writing letters and will continue to do this (Issues: Sinclair Broadcasting; No Child Left Behind). What I will be is "one of the masses" who will add support to your (our) cause.
