Why I don't fear Crisco Johnny as a Supreme Court justice |

Let's say Chief Justice Rehnquist drops dead tonight and Bush chooses John Ashcroft to replace him.
I don't see much of a problem in that, and here's why...
1) Ashcroft is 62 years old. He can't live forever, even though evil only prolongs the lifespan of those who practice it. If he lives to 80, that's only 18 years to attempt to destroy America. And by the time that happens, we should have solved the BBV problem and can put a Democratic president in office.
2) Rehnquist and Ashcroft are both wingnuts. Ashcroft would be a direct replacement for Rehnquist--the bolt holes even line up. If we were in danger of losing Ruth Bader Ginsburg or Stephen Breyer--a liberal member of the Court--I wouldn't be writing this piece, but since we're dealing with William Rehnquist, it's different. In fact, we could lose Rehnquist, Antonin Scalia and Clarence Thomas in this term, have them replaced with Ashcroft and two wingnuts to be named at a later date, and really be in no worse shape than we are in now.
3) The Republican leadership really doesn't want Roe v. Wade overturned or gay marriage outlawed; if either happened they'd have to buy themselves a new bogeyman. Let's see...Saddam's in jail, Osama's lost his punch, they're out of communists...all they gots left is dem dere uppity faggits who are gunna git married like respectable Americans, fuck up a honeymoon bed at some unsuspectin' hotel with a good respectable name like "The No Tell Motel" with faggit sex, then git faggit abortions when they get each other pregnant. And without that...why, they'd have to let Saddam loose so they could hate him again.
I also don't think the entire Republican rank-and-file is religiously insane; Ashcroft may turn some of them blue.
I don't want the fucker on the court; I really don't want any of my tax dollars going into his pocket. But it could be worse: Bush could put Roy Moore or Ted Olson on the Court.

BushCo makes the fight that easy for us but I doubt even he would be that stupid - of course, he has surprised me many times with the depth of his stupidity (so has half of the American people but that is a different story).

if * were to appoint Scalia or Thomas to Chief Justice (or Kennedy for that matter, then replace one of them with Ashcroft, he gets a two-fer and swings the court balance (see Reagan/Renquist; no one thought that Renquist, the farthest out of the mainstream Justice would pass m,uster)then again with Zell Miller gone and the Dems needing to replace the marginally effective minority leader Daschle we may yet have a chance at party discipline and hold the line (60 votes needed for CHief Justice?).
then again, Russ Feingold was the deciding vote for ashcroft as AG... he thought the guy deserved a chance.

How does replacing one wingnut (Rehnquist) with another wingnut (CJ) swing the court's balance? Right now there is a reliable conservative majority with one WN--O'Connor--that occasionally votes with the four liberals.
If we were discussing replacing Sandra Day O'Connor with CJ, I would worry. But Rehnquist is so far to the right, he'll order a waffle at IHOP and ask for a "conservative" dollop of blueberries.
In short, he can't fuck it up any worse than it is now.
