BBV: 7 Counties In WA State Now Using Uncertified Software |

The "emergency" rule change that allowed 'conditional' certification of the vote counting software in 7 counties is no longer in existence. "Emergency" rule changes are only good for 120 days. The change was written and submitted on 16 July so it was no longer any good as of 13 November.
This means that any ballots still being counted by machine in Snohomish, King, Pierce, Kitsap, Klickitat, Chelan, and Yakima Counties are not legally being counted. This also means that if there are any recounts in any of those counties, the recounts can ONLY be done by hand.
We still have a Governor's race that is not decided and may well fall into the recount limits. Anyone living in Washington state needs to call the state Democratic Party in Seattle and the Chris Gregoire campaign and ask them to demand that any recounts be conducted by hand count. We need the numbers to compare with the machine counts.

The Assistant Attorney General has decided that the software is still good even though the rule that made it certified is no longer in effect. The law allowed the software to be certified through the primary and the general election so the fact that the law is no longer in existence does not matter.
