Supreme Court: Mental Disabilities Must be Considered
The Supreme Court is apparently asleep at the wheel. That is the only excuse for letting a thing like compassion and logic get in the way of a court ruling. The Supreme Court stopped the execution of a Texas man based on the fact that the jury had not been allowed to consider the defendants mental disabilities or age(like not having the ability to form the malicious intent required to commit a crime should really be a factor).

The Court voted 7 to 2 to stop Texas (reigning champ among the states in killing its residents) from executing its 23rd resident this year (all the other states only have 36 combined--pitiful) when LaRoyce Smith's appeal was denied by a lower court. Give you two guesses as to which two "Justices" voted to fry the guy without review. You got it! Antonin Scalia and Antonin Scalia Jr. a.k.a Clarence Thomas. Scalia gave no comment about his dissent and issued no opinion. Scalia Jr. is by all accounts a deaf mute.
