"A judge refused yesterday to order the counting of ballots in the San Diego mayoral race in which voters wrote in the name of Councilwoman Donna Frye but neglected to fill in a small oval-shaped bubble next to it."

Shouldnt all votes be counted? Even if the bubble wasnt filled in THE NAME WAS WRITTEN IN THE WRITE-IN SECTION?

Those ant-lawsuit repugs are about to win again in San Diego.

I thought the general rule was that a vote is supposed to be counted if the voter's intent is obvious. So what's the excuse for not counting it? "Well folks, even though the candidate's name is clearly written on the ballot, the voter didn't color in the little bubble, so we can't possibly be sure of who they wanted to vote for!" :eyes:

agree with this ruling if the law says blacken the bubble and it is blank that is a no vote. As a test reverse the party would you say the vote counts if the write was for a republican?

If a repug was in the same position the vote would be counted.

"She said the registrar has been correcting and counting ballots with so-called over-votes in a procedure known as "remaking." Those are ballots where the bubble next to Murphy's name was shaded in, and a voter also wrote-in the mayor's name below, she said.

The registrar, discerning the voter clearly intended to vote for Murphy, is correcting those ballots by whiting-out the write-in vote, she said, which is allowed under the Elections Code. "


So they can white out the problems on the republican ballots, but can't use the write ins for the democrat. Appalling.

5. I understood it differently
I thought some had filled in the Murphy bubble, and written Murphy's name, and those were being corrected.

They all ought to be counted, if the intent can be determined. I wish I was there so I could protest.

7. It sure seems like a clear intent to vote for the write-in candidate
even if they didn't fill in the bubble. Isn't there a law that says the intent of the voter should count?
