BBV: Volusia County lawsuit filed
Two citizens of courage in Volusia County have stepped up to the plate on behalf of all of us, seeking to clean up elections.

Susan Pynchon, a local citizen, and Daniel Vaughen, a local attorney, have filed a lawsuit to set aside the Volusia County election.

Here is a summary of the allegations, and this should illustrate the importance of the public records request for diagnostic audit materials, filed by Black Box Voting in every county in the U.S. on election night, Nov. 2:

a. The Supervisor of Elections has unreasonably delayed providing information.

b. The certification was based on inadequate and incomplete information regarding the election results.

6. Some or all of the information requested on Nov. 2, 2004 by Black Box Voting is still missing from 59 of the 179 voting precincts, including portions of or all of the voting machine tapes for those 59 precincts, which are a vital part of official paper record of the election results from those precincts.

7. Complete information on problems with the voting machines prior to and during the election has not been provided.

8. Complete information relating to memory card failures during the election has not yet been provided.

9. Only a partial list of the transmission logs from the Accu-Vote optical scan server has been provided. Despite repeated requests, the Elections office has refused to provide to the Volusia County Democratic party the official election results, now stating that those results will not be available until December 1, 2004.

10. The Elections office has provided incomplete data regarding Early Voting and Absentee ballots. The Supervisor of Elections, for example, reported that the total number of absentee ballots and Early voting ballots, combined equaled 89,999 votes, yet the published figures for those totals is 84,100 votes, leaving over 5,800 votes unaccounted for.

11. In addition to the pattern of delay in providing the requested information, the true election results are in doubt because of numerous violations of election law procedure and unanswered questions concerning the results.

12. The polls were opened early and closed late during Early Voting.

13. Many public records, including one signed results tape from a voting machine were found in the trash. Many of the requested records not furnished by the Elections office have been found in the trash. Results from the tapes found in the trash do not match the results of the copies of tapes furnished.

14. An email from Mark Earley, of Diebold Elections Systems, Inc., to the Elections office was provided which asked the recipient for an explanation of why Volusia County had more memory card failures than all of their other Florida customers combined, and then asked why the 17 memory card failures which the Elections office reported on November 3, increased to 25 before November 12, 2004.

15. The reported memory card failures were significant and troubling and included reporting zero votes after one week of voting, requesting permission to upload votes before the voting began, and messaging whether the card should be reformatted.

16. According to a statement by the Supervisor of Elections on November 17, 2004, the GEMS computer is not networked, and is "stand alone." The furnished computer logs show evidence of at least two attempts to remotely access the GEMS central tabulator, which is claimed to be secure. A computer screen shot printout on November 17, 2004 (found in the trash) shows that the GEMS computer at that time had two networked hard drives.

5. You want to know how sneaky these bastards are?
On a local pet project of the City and good ole boys, they sent out ballots for a straw vote, (a straw vote if they lost, evidence to support the City's position if they won.) When the City didn't win in the allotted time, the City Manager extended the voting period by a few days -- but he didn't make a public announcement. By the end of the time, the City won the vote by less than half a dozen votes. With that, the City ramroded their project, buying bonds from a good ole boy bonding company that in the past had over charged for the cost of bonds.

And this dumb, idiotic Republican municipality was just thrilled about it.

8. Hah! good one, but can you do a poem for this:
Volusia has paper ballots, but they are locked in a vault.
Volusia had signed poll tape results, but now the sigs are missing.
Volusia's trash was more informative than their public records responses.
Now Volusia won't talk to us in a public place. (We are only allowed to go "one on one" in private offices with no record made of what transpires, an offer we have refused).

We are told the precious votes are safely tucked inside the vault.
Who holds the keys is the big question.
Are they in the hands of the Elves of Rove?

How many votes did Velusia County report for Bush and Kerry?

Keep up the great work! I'm outraged over CNN's refusal to air videotaped evidence of fraud right in front of their eyes. I just heard that there's a march on Washington to protest the election being organized for December 11th, 2 days before the Electoral College votes. You should hold a press conference in front of the Capital (or wherever they're marching to) and pass out copies of your videos and other evidence to everyone who wants the truth.

Yes, but those silly "reaction photos" (“Whuuut?” etc.) in the Nov. 7th portion of the BBV Home page are detracting from the message and need to be removed ASAP (it would take about 30 seconds during the next update of the home page).

Bev, I've tried repeatedly to get this message to you, and many of the BBV forum users and donors (I gave $$) agree that the photos are a big problem in people taking the website seriously. Please, PLEASE remove them.

24. We will. They did their duty
We needed to appeal to the slashdot and geek community for that story, and it worked. We had so many downloads of the "be your own ITA" files that it maxed our very large bandwidth.

We got a lot of detailed reports. Good stuff.

By the way, we are taken seriously. Every major news outlet in the United States reads our web site regularly and calls us all the time.

Don't stress about this so much. And it will be tomorrow before we remove the photos, which got just as many high marks as low marks.

25. Sounds like a job for the ACLU.
More people, more money, more lawyers, more connections, and more pressure are needed.

Bev has worked tirelessly in one County, and it sounds like the right things are being done there. But it also sounds like Florida law requires that many more votes in many more areas need to be found questionable in order to legally challenge state results.

If this is happening in Volusia, it could be happening elsewhere...in other counties, in other states.

This issue seems tailor-made for ACLU. THEY SHOULD BE ON THIS HARD! They are cold, they are persistent, they have resources, they are everywhere. They are feared.

Seems to me this needs to be ramped up big time so that, even if the election is not overturned due to obstructionist Florida law, we fully understand all the tampering. The full scope needs to be known. The entire nation and the world need to know what a disaster this is and doubt needs to be cast on the election so that people are motivated to do something about it this time.

I fear that the story of corruption in one county by a couple of officials will not make lasting headlines or more than 10 seconds on Aaron Brown.

Seems to me there is clear evidence of election tampering in Florida. I have to ask you why is it that the Democratic Party went AWOL on this issue? Some of the thoughts floating out there are:
1. They are in league with the republicans and it is just a game they play to humor us citizens.
2. They have been threatened with some Anthrax from a rouge element of the US Government if they cry foul! After all wasn't it Democratic Senators that were targeted last time?

There will be no clearing of the air about this election if the Democratic Party does not standup and demand a full accounting for the vote and the truth as to honesty of the manufactures of the Black Box electronic voting systems in use today. I call upon you and your colleagues to stand up and demand that a full and open investigation be done at the very least it would help if your office would back up Bev Harris with calls to the election officials that have been stonewalling her requests under the Freedom of information act so as to verify that we were not cheated on Nov 2, 2004 of the primary act of citizenship the right to vote for your representatives before congress and your president if we can not prove the election was fair then we lower our selves to Banana republic status
How is it that the US government can challenge an election in the Ukraine while our voting system here in the US is being closed to open viewing by citizen voting rights advocates! There is now a new cry out in the blogosphere of Taxation without Representation and there will be protest demonstrations with people throwing tea into the harbors around the country! How can we be paying for democracy in Iraq with our most precious treasure our Children’s blood along with huge amounts of the nation’s treasury while it seems more and more apparent that we no longer have a true democracy here at home the so called land of the free!

We need you and your close colleagues to break the media silence and support our efforts to prove the system is either working properly or seriously broke! Thank you sincerely

33. ACLU interest
I would think the ACLU's interest would not necessarily be to overturn the election or contest the state, but it would be to uncover fraud and restore voting power to the public.

This seems like a quintessesntial ACLU case, regardless of filing deadlines. Voting is a civil right.

In fact I can't think of a more appropriate ACLU issue.

Could you please post this information. Once the video hits the blogosphere, the MSM may have no choice but to run the story. Not forcing the MSM to cover this tory is doing a dis-serivice to our cause.
