Question about backdoor draft -

Question about backdoor draft -
I heard on 60 minutes last night and again on local news tonight that calling back soldiers who have left the service is allowed due to war or national emergency.

This rang a bell with me, because I was classified 1Y during the Vietnam "war" and was told I could only be called if a national emergency was declared.

So far as I know, a national emergency was not declared during Vietnam, and it was pretty much understood that "war" meant actual declared war.

My point - How can they call these guys up without some official declaration, either of war or national emergency? Is this another formality which will simply be blown off?

1. It seems to me
that *hrub can do anything he wants. It's pretty scary when you think what he's up to. His is trying to hold off that draft as long as he can. We had this discussion at work today and we have all come to the conclusion that some where in the mid part of 2005, that draft notices will do out. There is no way around it.Someone in the group said they had it on a good source it would be JUNE.. baton down the hatches

4. Who owns congress?
What is the majority now sitting on congress? Dems are out voted by how much?

How many yes'em people are being put into place?

you don't think the moral value people in congress will prevent a draft do you?

7. They are trying to play a loophole
That's why some of the soldiers caught in stop loss have filed a lawsuit for breech of contract.

Unfortunately, it's going to be damned if you do and damned if you don't. That is, it will be decided by the courts. I'm assured they will fall on the side of the men in uniform -- those who have completed their military contracts. This will give the neocons opportunity to spin the draft as being the fault of the "activists" judges.

I think the soldiers have a case in their is no declared state of war as defined by the constitution.

What "state of emergency" means ... I do not know. But I'm pretty sure our nation is NOT in a "state of emergency", meaning our country could potentially cease to exist unless these troops are called up.

A successfull challenge could be interesting. If a court rules that a constitutional state of war MUST exist, than congress would need to officially declare war to get these guys into service. But .... WHO do they declare war against???? Would they declare war against the "Iraqi Insurgents"?????

9. Here's a link to Vietnam era draft classifications
I was 1y - draftable only in war or national emergency, and I was never called because - ta-da - there a=was no war or national emergency. So if Vietnam was not a war or national emergency, why is the current situation any different?
