Police Investigate 11 Year Old Boy For Being "Un-American"
When the two plainclothes Loudoun County sheriff's investigators showed up on her Leesburg doorstep, Pamela Albaugh got nervous. But when they told her why they were there, she got angry: A complaint had been filed alleging that her 11-year old son had made "anti-American and violent" statements in school.

Albaugh described her son as a rambunctious student who has long opposed armies of any kind. He refused the Veterans Day assignment and told his teacher that the Marines "might as well die, as much as I care." Whatever was said, the words had been the source of anguished conferences, phone calls and, ultimately, a day of in-school suspension.

Albaugh thought the whole thing was resolved in school until Investigators Robert LeBlanc and Kelly Poland showed up last week. What followed, she said, was two hours of polite but intense and personal questioning.

They asked how she felt about 9/11 and the military. They asked whether she knows any foreigners who have trouble with American policy. They mentioned a German friend who had been staying with the family and asked whether the friend sympathized with the Taliban. They also inquired whether she might be teaching her children "anti-American values," she said.

Seriously, what legal right do the authorities have to come into one's home and ask these questions?

My 12 year old son is pretty outspoken, and we live in a very conservative area. I wonder how I would have reacted if this had happened to us.

This woman thought the whole thing was resolved and her child had been disciplined, but now someone shows up appearing to be investigatind HER behavior and parenting?

Do you have to let investigators into your home? What happens if you don't? Do you have to answer questions?

Have we reached the point where we need to have the name of an attorney handy in case the knock on the door comes?

The fact is that the founding fathers are rolling in their graves with even the threat of this nonsense from any American entity. But here we go... words to guide you from the ACLU:

Q: What if agents appear at my door and do not have a search warrant?

A: You do not have to let the police into your home or allow them to search your home. You have the right to remain silent and do not have to answer their questions. It is a good idea to talk to a lawyer before agreeing to answer questions. You do not have to talk to anyone, even if you have been arrested or are in jail. Only a judge can order you to answer questions

Q: Can agents search my home or office?

A: Police or other law enforcement agents cannot enter and search your home unless you give them permission, or unless they have a search or arrest warrant. A warrant, which you may ask to see, is a court order specifying the place to be searched, and the persons or things to be seized. If there is no warrant, you should say clearly that you have not given your consent and that the search is against your wishes. Interfering with an unauthorized search probably will not stop it, and you might get arrested. Your roommate or guest can legally consent to a search of your house if the police believe that person has the authority to give consent. I find that it helps to know all of the fourth amendment and at least the last bit of the fifth amendment (from whence we get the phrase "taking the 5th") verbatim:

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

in World History class they announced that Regan had been shot, and they turned on the television. I said, "I hope he dies." Boy did I get flack for that...from my fellow students. If incident happened now instead of then, I'll bet the flack would be from more than just my fellow students. Heck, I'd probably be labelled a "dissident," or maybe even "enemy combatant."

54. In Florida, HRS snatched a Downs child because her mother
complained to school officials in Okaloosa County that her child was getting off the bus with bruises. The school officials accused her of abuse and it took over a year to get the child back.

Kudos to the NW Daily News on this one.

That great state that can't keep track of many of the children in the welfare system. At least one child has disappeared totally.

Stories like that are horrifying. But they shouldn't stop any of us from standing up for our right to speak out. That's the kind of intimidation fascist states do so well.

Yeah, I'll bet one child HAS disappered entirely. Probably spoke up against Bush, and the HRS people probably shot the kid in the head, buried it in an unmarked grave at midnight, and then reported the kid as completely missing.

No, what's happened is that due to incompetence (which includes underfunding the department and overworking the social workers) children have been lost track of and no one knows where they are.

The specific case I'm familiar with is of a little girl who was placed in foster care, and then at some point someone, supposedly another Social Services person, came to the house and took the little girl away. The foster parents have no idea exactly who took her, where she went. The foster care system has no records of the girl being placed in another home. The biological mother is distraught to say the least. This was at least two years ago.

As a result of a research project on a tangential topic this semester I began reading about the "Sociological Department" that Henry Ford began at his company. The officers of the sociological dept. would visit employee houses to make sure the food they served, their home decor, their mannerisms, etc. were sufficiently "American." Sometimes it seems frighteningly plausible for such a thing to come back in style.

this is spooky. We're in a red state, but it's no secret that we don't agree with the way things are going. I don't think that my son would say anything quite like that, as my brother is deployed, and he adores his uncle very much. However, I was told that when their school held mock debates and elections, a friend of his booed at the kid playing * and was sent to the office for it. His mother was pissed...but didn't really do anything about it. Since when is booing something that you get sent to the office for?

Back to the original topic...The thought police don't want to come knocking on my door. They will find a family of people who will think for themselves no matter what. I'm known for being quite stubborn!

I used to think, when I heard of stuff like this, oh, well, another extreme example. No need to get our panties in a twist, there's always some cop or something who goes too far... good thing the media's on top of it and keeping people in line.

But I have a real sense these days that things like this will keep happening, and soon it will be Normal. In fact, the purpose of the story is to MAKE us get used to it.

How do you like the new normal?

Here is another little snip from the article;

Yishai Asido, was assigned to write a letter to U.S. Marines and responded, according to his teacher, by saying, "I wish all Americans were dead and that American soldiers should die." Yishai and Albaugh deny that the boy wished his countrymen dead.

um, well, I would be a bit troubled if my 11 year came home from school and told me a classmate made this statement. I wouldn't run to the press, but, I would go to school.

While they may have gone overboard a bit, but their explanation has merit. If they did nothing, and the boy actually ACTED violently in the near future.... everyone would be asking why they did nothing at all.

I hate stuff like this.. double edged sword.

I know what you are trying to say, but if they were really concerned with violence, they should have limited their questions to issues concerning violence. As soon as they start asking about political opinions, they aren't trying to stop violence, they are trying to oppress dissent.
If they were interested in the political questions because they wanted to use that to stop violence, they should have questioned the teacher and told her never to give an assignment that will upset kids who don't like to see Iraqis killed.

When I was around 11 years old, I had already started to feel very strongly about peace and justice issues. For some dumb reason, the church my family attended sang "God Bless America" every Sunday. I was so irritated by the blatant merging of religion and nationalism, I started making up my own words to the song.

I don't recall what those words were, but my mother heard me once and got really mad. She told me about how wonderful this country is and how I should be proud to live here and blah blah blah . . .

Well, I can't say I'm very proud of my nation right now. Instead of singing "God Bless America," I'd rather say, "God help us--please!"

In any case, I don't agree with the specific thing the child said. But there was no cause for such badgering by the police. Welcome to the U. S. (S. R.), comrades.

The real enemies of Repukes are those who care about the poor, about soldiers having what they need to survive their War for Oil. I sure am glad I lived in a blue state. I'm wearing my anti-bush t-shirt as soon as I get it in front of all those freeper freaks.Heres a story: My drama teacher was was impersonating a hillbilly who voted for bush and wanted her cow to be able to vote for bush, so I booed when her character said she would vote for bush. She then (only in character) called me a 'massachusetts liberal' and I cheered along with my jewish friend for the name. My parents were not notified. What a difference the state makes.

This is exactly how things began in Nazi Germany with people being accused of not supporting the German cause and of being "un-German". I recall a post here about a month ago saying that some nutcase had reported DU to Homeland Security saying that this was a subversive site. While I wanted to discount this as just the babbling of a nutjob, it is very clear to me that soon everything we say here will be subject to review by the authorities and that we may well all end up being investigated for "un-American" activities. This harkens back to the witch trials of the McCarthy era.

And of course the sheeple just sit back. As long as they can afford to put gas in the SUV, get tickets to the NASCAR race and dial up Domino for dinner while watching mindless "reality shows" on TV, they are fat, dumb and happy. And this is what this administration wants, automotrons.

Where is the outrage? I saw "an economist" being interviewed on one of the mind-dumming cable shows late last night gleefully hoping that shrub's second term would mean an end to taxes on dividends. And where is the outrage? Why do people who work for a living have their income subjected to tax while the fat cats who just sit back and collect dividends pay NOTHING?

I fear we have crossed the threshhold where all hope is lost. I hope I am wrong but I'm not very optimistic.

Not one poster has said..
"there must be more to the story. Things like this don't happen in America"..

Shows you how much the US has changed since bushie boy took office..and how our civil liberties and freedom has been impacted.

5 yrs ago a story like this would have been met w/sceptism by most people...and cries of "we aren't being told the whole story"..

now (whether there is more to the story or not) we have no problem believing that it *could* have occured exactly as written.

Sad commentary on the state of liberty and freedom in the USA....

You don't know what its like in schools today. This kid got off easy with only a one day in-school suspension. I know kids who have done and said less and are now in alternative schools. School today is not about learning it is all about control.

71. Your response says it all for me...my grandson has been moved
to three alternative schools already! The ZERO tolerance thing is sooooooooooo fucked up. Kids can't have an individual thought, an individual emotion, a slip up of any kind, lest their education stream be totally interupted by sending them to this place and that. My grandson is showing signs of losing hope in his future.

I've encouraged him to agree to take some early college courses so he can continue in an environment of academic achievement. He is of Mexican decent with a 3.5 gpa BTW.

It is all I can do to keep him "positive". In my day,(ahem)if a kid acted out in a negative way, they got suspended or got detention, a few phone calls or whatever.. Today, they get the police on your ass, kick them out of school(or transfer) after more than three "incidents" in one whole school year, or send them to juvenile hall for a little condecending chat, sometimes they make them do volunteer work.

I'm ABSOLUTELY APPALLED at what the school considers "heinous" enough to remove or transfer kids for. FREE THOUGHT and room for mistakes in school are a thing of the past!

What this kid in the article did would warrant the treatment I described if he were in my community, which is bad enough. The kid shouldn't have popped off with the crap he said, but coming to the families home to "investigate" the parents is WAY OVER THE GDAMED TOP!

Public School has become a dangerous place to send our kids!

Now we have the BIG GUNS coming to homes? This pisses me off to NO END. Come to MY house and you are going to have to take ME to jail. :grr: ~~FILM AT 11~~

Man, I woulda never made it past kindergarten in THAT environment...holy shit...as outspoken and opinionated as I am...and always was...no fuckin' way I woulda even made it out of kindergarten before getting shipped off to some "alternative school!"

Hell, I was labelled "emotionally disturbed" and placed in Special Education from first grade till fifth, because, back then, schools didn't know what to do with hyper-intelligent kids like me. I was not emotionally disturbed, I wasn't a bad kid...I just knew everything they were trying to teach at my grade level, already, and was bored off my ass!

At that age...it didn't occur to me that I was above average, I thought everyone else around me was STUPID. It never occurred to me that knowing the multiplication tables to twelve, and reading a newspaper were things a normal kindergartner could not do! Because I COULD!

So, needless to say, I made a lot of trouble and mayhem, because I was bored off my ass. It drove me crazy! Here I am, reading in the newspapers about the Space Shuttle and the Neutron Bomb, and the Jimmy Carter Administration...and multiplying up to 12 in my head...in KINDERGARTEN...and nothing drove me crazier than slow learners, and under-achievers. so what, in all their wisdom, did they do?? Stuck me in Special Education...with a shitload of slow learners and underachievers!

I had to go so far as to take control of my own education, and my parents helped in that regard...buying me complex books, textboooks, etc. I was reading at a ninth-grade level in the second grade!

FINALLY, they got it. The public school system got it because the fucking Illinois Supreme court MADE them get it. These bastards tried to ship me off to the Brown Schools. My parents fought it and fought it...and went so far as to appeal the case all the way up to the Illinois Supreme court, under Public Law 94-142 (I think that was it) and the public school system finally threw up it's hands on me, and paid my full tuition to a lab school attached to the University of Chicago.

I went to UC at the age of ten years old, and the public school system paid for it! this lab school I went to...you went to school 12 months a year...no summer vacation. You lived at the school. In a dormitory. With pther kids just like me...over-bright, overintelligent kids. And they gave you as challenging work as you could handle. If you read at a 10th grade level, did math at an undergraduate level, then that was what they set you to.

I began learning the Latin language at the age of ten, at UC. I was, by that time, doing algebra, and reading the most complex psych and law books, and actually understanding what I was reading!

I was at that school until I was 14. Then, my parents moved to Texas. The school board contended since my parents no longer lived in-state, they were no longer responsible for me.

Meanwhile, Texas refused to pick up the tab in Illinois beyond my finishing the school year I was currently in. by that time, I had already more than achieved enough to not even have to attend high school. I chose to, anyway, because there wasn't much else I could do...and to get the social experience.

That school saved my life. I only wish I'd been able to stay there longer.

SO...what has all this great intelligence gotten me in life? A big, fat zero, because of the cruelties of capitalism, I have been unable to complete my college, so I'm not "qualified" for the kind of jobs I really NEED to be doing...and I end up stuck in dead-end entry-level jobs. And there doesn't seem to be any financial possibility to go on to college again, what with having to work two fucking jobs just to make ends meet!

Thanks to the rotten economic system in America, I, basically, have been denied a chance to grow to my fullest potential, and it don't look to be getting better any time soon. And I just got canned from another of these shit jobs on Wednesday.

I'm about to the point of giving the hell up. My mom has offered me a chance to move back home with her, work part-time, and go back to school. It may be the only way I ever get a chance to get out of the rut I am in in this life, but it means leaving Texas, the place I love...and going back up to bitter-cold Pennsylvania. and giving up my independence...I have lived on my own for over ten years now.

but I can't just keep spinning my wheels. I keep doing the same things, hoping for a different result, and that just doesn't seem very practical. I may well end up leaving Texas in May, because of this...because I cannot go on with no hope. At least, if I live with my mom, I could have a chance to finish my fucking education, and get myself in the kind of job I need to be in...and could actually be happy doing.

But, damn, I never would survive PUBLIC school in this day and age. No fuckin' way. I'm way too opinionated, and individualistic for that.
