Did Rush say anything today about SNL making fun of him?
He must have! He can dish it out but CAN NOT STAND ANYONE making fun of him. Period.End of Statement! He must be funing. Does anyone know if he addressed this today?

First there was the Shrub gloat-a-thon to deal with. But eventually one of his dittoheads will ask him about it and he will say he is too BIG (boy is THAT the truth) to worry about GNATS. It's what he's said before.

5. Rush's drug abuse is an instance where he was caught red-handed
being a first rate hypocrite, and he knows it. Therefore, I don't think he's going to draw a lot of attention to it.

His medical records were possibly obtained illegally. That issue is still being fought in our court here in FL. DA's here think the case won't go anywhere. Rush's attorney is one ofthe best in fl. He's run circles around the prosecution. You know how it is, the more money you have, the more that justice is negotiable!! Thought here in Palm Beach is that he'll NEVER do time!

15. Hypocracy...
Rush is a drug addict. That is his crime. He is getting his day (or months) in court. He's hired a good lawyer as all celebrities do, and certainly he's going to need it. He's claimed that his privacy rights were violated in the way that his medical records were seized, and the ACLU seems to agree with him. I imagine that the ACLU isn't doing this out of any personal love for Rush, but because what happened may set a dangerous precident for others. From what I understand, in Florida, there is a specific process for obtaining medical records as evidence, which makes it much more difficult than simply obtaining a search warrant, which was how his records were obtained. IMHO, if the government is able to seize anyone's records simply by finding a judge willing to issue the warrant, than this is a serious threat to privacy rights. Hypocracy, on the other hand, is not illegal in the US which I guess is a good thing for those here at DU who feel that:

A) Everyone is entitled to their day in court and their privacy protections under the constitution, unless it's a conservative.

and B) Drug addiction is a horrible thing to happen to anyone, and it should not be handled by throwing addicts in jail, but through treatement and education, unless it's a conservative.

IMHO, these are also both excellent examples of hypocracy.

He is not being prosecuted for being an addict. He is being prosecuted for "doctor shopping", which is illegal in the state of Florida. The state had reasonable cause to look at his medical records because there was sufficient evidence of doctor shopping after the state interviewed pharmacists and found that he was getting prescriptions filled all over town.

Sorry, but just because he managed to include his doctors in his nefarious activities that doesn't mean he gets a free pass. It's not as though the prosecutor was on a fishing expedition investigating an unrelated crime having nothing to do with his medical records or doctors. They had probable cause to believe he was doctor shopping. They weren't investigating J-walking.

BTW, there are plenty of poor people doing time for similar "victim-less crimes"

That they not prosecute him or that he get a free pass, and, yes, his crime is doctor shopping. Being an addict is not in and of itself illegal. If the state of Florida has reasonable cause to look into his records, there is a process for obtaining them (subpoena). This is not how they chose to do it. The standard for obtaining the subpoena is much higher than that of a search warrant and IMO, it should be. Had they done it this way, I would have no complaints at all about the prosecution. Had they done it this way, I would not see the same attack on privacy rights.

My points about hypocracy goes to the fact that had this happened to Al Franken, for example, the some of the same people who want to lynch Limpballs would be talking about the injustice of the law itself, and the violation of his privacy. For those who just want to see Rush in jail, are they willing to do this at the expense of what might be someone else's privacy rights in the future.

Is this your opinion or do you have some case law to back it up?
Both have to show probable cause in front of a judge. Perhaps the prosecutor felt the records would be in jeopardy.

Either way, just because "doctor's office" is attached to this case doesn't mean the prosecutor has to start dancing on the head of a pin. Sure there is doctor/patient confidentiality but guess what- When you involve your doctor in your crime, or your attorney for that matter, you lose some of your protections. It's that simple.

As for the hypocrisy angle. Let's call a truce with our right wing friends......right after we lock this fat f--ck up.

If they can prove that there was a crime without the medical records, why was he not already indicted? If they can't prove that he has done anything illegal, should they be able to get his records on the suspicion that he may have done something illegal? Should they be able to do this without following the established legal process? If so, would the government be able to access medical records of anyone involved in any crime that might relate to their medical history and thumb through them as they see fit without judicial oversight?

Frankly, I'd like to see him go to jail, but it's more important to protect privacy rights, than to see him convicted and get a minimum sentence. If they can do both, I'm all for it.

31. It looks like the state,
and I'm only reading the argument from the ACLU and The pill Popper's point of view, thinks that they can get away with a warrant(and seizure) as it requires a higher degree of probable cause than the subpoena. In other words, the subpoena is applicable when on a "fishing expedition" and the warrant/seizure is applicable when strong probable cause is there to support a crime.

It's hard to say without seeing the states side of the argument as I am not familiar with Florida law but two courts have sided with the state.

Anyway, if the big fat bag of pills thinks his rights have been violated, might I suggest he think of the process as a "fraternity prank." You know, like a pantie raid but with Fatty's records being the panties.......it was good enough for the Iraqi prisoners.

They probably have a case against Fatty Cakes for money laundering or "structuring", to be exact. The term money laundering has been tossed about and can be misleading because it brings to mind big time dealers like "Tony Montana" or other big drug king-pins. Structuring is the act of intentionally structuring a transaction in a way to avoid IRS reporting laws.

By his own admission, he says he pulled all that cash out to "pay his contractor" and did it in increments of less than 10k to avoid the reporting laws on the advice of his banker. The suspicion is the money went to his dealer. Either way he either "structured" his transactions to avoid IRS reporting for himself or his contractor. Both scenarios are illegal. People are prosecuted for this every day. Fat Bastard put his foot in his mouth on this one. And I don't want to hear "Mr. Talent on loan from god" try to say he didn't know it was illegal.

30. It doesn't have anything to do with the medical records.
That's why I said it was a BTW or a side note. Most likely a federal charge. I heard him admit, with my own lying ears, that he structured the deal on the advice of his bank so as to avoid the IRS 10,000 dollar reporting law. The bank is in trouble too. More so than El Fatbo.

GUILTY. Take him out back and shoot him. "Another dead doper" to use his words.
