The Bushists called this tendency of his "flip-flopping" because they're too stupid and lazy to say what it really is, which is seeming to have no position on anything at all. What Kerry does is more passsive than flip-flopping. Vastly more subtle and sophisticated, too. But a lot of good it does him or, more to the point, Democrats and progressives.

It is very clearly targeted at disenfranchising African-American voters who are far more likely to be arrested and convicted of a felony. There's a reason most of the states who don't allow ex-felons to vote are in the South. It is another form of Jim Crow.
