Lawsuit Filed Against Bush & Cheney - PNAC Allegations

Lawsuit Filed in U.S. District Court in Reno Against George W. Bush and Richard B. Cheney

WASHINGTON -- January 18 -- A lawsuit was filed late Friday January 14th in the U.S. District Court in Reno, Nevada against President Bush and Vice President Cheney. The lawsuit alleges that both defendants have acted outside the scope of their job description in waging a war against Iraq. The complaint alleges that both defendants and others working within the White House and Defense Department have covertly implemented a white paper called “Rebuilding America’s Defenses” as presented by the Project for the New American Century or PNAC in September, 2000 two months before the murky elections of that year. Among the persons signing the paper were Richard Cheney and Jeb Bush. While the paper was published on the internet, implementation of it by the White House has been in secret.

1. Well, that was very interesting, to say the least.
DU legal eagles need to chime in. Will this be dismissed or become a viable lawsuit? If viable, can others join to make it a class action lawsuit?

In his Senate confirmation hearing, he deliberately sidestepped a question about one of the provisions in the now infamous torture memo about insulating the president from all prosecution during wartime.

It depends - if the next president (which will be Kerry) has a lapdog for AG like Gonzales, then, yes. However, since Kerry is a statesman, he won't nominate anyone for AG who wipes his ass with the constitution.

10. The first issue is
to consider what the goal of filing the suit was. My suspicion is that it was to bring the spot light of publicity to an issue that has been used to keep the public in the dark. And in that sense, it may accomplish its goal.

The case is likely to be dismissed at the level it had been filed. That doesn't have to be considered a bad thing. At issue may be how it is dismissed: does a court leave a door open, or shut it completely.

What is perhaps the most important is will it lead to members of the House using it to begin an investigation into the shadowy relationship between the administration and an unelected group deciding US policy.

The President is allowed to consult with whoever he damn well wants to, even if they are scum.

Doesn't matter if he had daily meetings at the AEI. It would be perfectly legal.

EDIT: This is similar to the Cheney Energy Taskforce meetings. SCOTUS was pretty clear there that the Executive Branch can solicit advice from anyone it likes.

And, judging from the PNAC's motives, I'd say they put Israel above the United States.

Not ragging on Israel, here - but it's treason to put one's on country at risk at the beheast of another.

6. I remember when public policy was debated in the open.
Instead of being made by a few white men bought and paid for by Big Oil.

15. I checked out his site. He asked for help sending a letter to the court.
It's attaches the last page of the photocopy of the court filing. It's takes a long time to load, so Here is a copy. I'm going to send one, and I think you should too. He said he would love to have the court receive over 100,000 letters. I think we should help him.

We are a peace loving nation and have always stood up for the equal rights of all persons in the world. We are opposed to any effort to further enlarge the dominant power of the United States and indeed seek to bring our nation back into line as a brotherhood of nations.

Please accept this letter as an indication of my/our desire to be among the class of citizens
of plaintiffs for which Mr. Wallace is defending the Constitution.
