And the person who owns the copyright (which would either be Dean or the photographer, depending on whether the photographer gave his rights to Dean or not) is legally entitled to whatever salary the webdesigner got for designing the site, along with legal fees, and they could make a damned good case for also getting the profits of any items sold while the photo was still online.

If the people in the picture want to claim damages, that's a separate issue on top of this, which I'm not as well versed in.

I'm a graphic artist professionally, and I have a flair for the old switcheroo with pics. Comes in really handy in the news business.

Seriously, even my mom looked at the pic and knew it was fake without seeing the original. They could have at least cut the pic out clean and toned down the shine on his greasy head.

I just might contact the Warner 2008 or Clark 2008 campaigns, if they ever get started.

photoshop someone into a picture so that most people could never tell the difference. I'm not saying that because I'm a super genius photoshop whiz- far from it. I'm saying it because, with photoshop, it's just not that hard. That's why I never automatically believe something just because someone produced a photo.

So for this to be as an atrocious hack job as it was, the "overzealous staffer" would have to be either a total idiot or a closet democrat trying to bring this guy down.

if you go to the link in post #60, you'll see that they admit to it and removed the image from their site. The Google cache has a link to it, but now it displays an empty box.

As a longtime graphic artist I am deeply offended by the poor quality of this forgery. The text doesn't even line up on the gilrs hat, the replacement text on the button in poorly placed, and above all, the placement poster is far too clean, it doesn't even have a layer of noise to match the grain in the photographs. geez, whoever this guy paid to fake this photo either really sucks or didn't get paid a whole lot.

If only I could sue for being offended by poor craftsmanship.

Bill Pascoe, a spokesman for Schundler's campaign, said the modified photo - which was used to promote purchases of Schundler campaign hats, shirts and other gear - was removed from the Web site after the campaign became aware of it.

The campaign was aware that Schundler's image was clipped and superimposed on a political rally photo, but they did not know it was taken at a Dean event, he said.

"It was a minor irritation for about 10 minutes yesterday," Pascoe said of the mishap, which came less than a week before Schundler faces six opponents in Tuesday's primary.

Rep. Kuhn(R) had flyers going through with his terrible face in front of a a backdrop of enthusiastic voters, a group of carefully diverse and posed people wallpapered over and over into a throng.

Why indeed is this the best they can do? Cheap, lazy, insulting and to some extent going through the motions since the real money in tactics is elsewhere.

I do suggest looking at flyers and posters of other campaigners since this might be a RNC major gaffe on behest of many of their candidates.

I wonder what outfit is doing a lot of the publicity work and for what payoff. This is the quality you get.

87. Pathetic. I recommend a request for an apology, not a lawsuit.
Schundler should issue a formal apology to Howard Dean and to his supporters in the pic. Unfortunately, a lawsuit will only make Dean look petty, whether he's within his rights or not. However, the photographer, if he owns the copyright, should most definitely go forward with legal action.

Repubs are the limbo party. The question always is, how low can they go?

I love that line of the poster above: They steal the votes and now they're stealing the voters. :thumbsup:

that this is a generic crowd photograph available to any number of ad agencies, and Howard Dean's pic was merely a better Photoshop job? Notice how Dean is out in front of the crowd.
If so, this would be embarassing in a "Gee, we both showed up at the party wearing the same dress," kind of way, but not quite as pathetic as stealing Dean's real supporters.
Is the DUer in the crowd confirmed? If so, I hope he or she sues, like the gay couple in the anti-AARP ad!

Apparently it is established procedure with he repugs. I remember around election time a Bush campaign photo was reveled to have a group of helmeted soldiers copied and pasted in the background to make the illusion of a much larger crowd. Later, Diebold latched onto this concept, as we know.

126. One of the high points of my life was calling Schundler a pig to his face
while he was campaigning for re-election as mayor of Jersey City one morning at the Journal Square PATH station.

I was already on my way down the escalator to the platform when I saw him, so there wasn't any way he could have had me clapped in irons or anything.

That turned out to be a complicated election cycle in which I ended up at the polls three times, to vote for city council candidates who I knew to be tied in with a corrupt machine, just because they weren't his candidates.

On second thought, maybe I shouldn't have insulted the porcine species by comparing them to SchundLIAR...

In this case, base on the evidence so far. It's Big Fish, the firm that does his website.

Schundler's Web site is operated by Big Fish, a Washington, D.C.-based marketing communications firm, which also did work for Dean last year. Tom Frank, the creative director for Big Fish, apologized to Schundler's campaign in a written statement and explained that the candidate had no knowledge of the photo's origin.


I'm just saying, let's choose more important battles.

edit: to be clear, the apparent fact that Big Fish didn't have a luxurious photo selection of Schundler surrounded by happy supporters may mean something. :)

IOW, let's mention some of Schundlers real downfalls, eh?

From the Bergen Record article cited above, reporting a Schundler campaign spokesman's response to the story: "The campaign was aware that Schundler's image was clipped and superimposed on a political rally photo, but they did not know it was taken at a Dean event, he said."

In other words, they had no problem with fraudulently portraying the enthusiasm for Schundler. They pulled the photo from their website only when they found out that there was some connection to -- gasp! -- Howard Dean.

Am I missing something clandestine about Big Fish, who also worked for Dean?

Isn't this simply a case of a designer at Big Fish making a Big Fuckup? They had a deadline and made a composite of the photos at hand?

I don't think this has reason to be politicized, nor does it deserve to be prominent on the DU homepage.

before! I do feel sorry for the skullified Deaniacs who got mixed up in this.

It would also be fun to set him up in other ridiculous, obviously contrived Photoshopped situations as in your first photo. Maybe überheroic ones where he is doing something he would obviously never dare to do in real life and with his head attached to a ridiculously overmuscular body. That would drive home his plagiarism. It could have a side by side comparison of the stolen Dean supporters pic and the original Dean pic, then a message that says something like
"This picture was stolen and modified to make Schundler look good - but why stop there?"
Then in the lower half there could be one of a series of different hilariously faked images - like a Tarzan-like figure battling a monster or a Superman figure fighting a riduculous supervillain or whatever. (Some people might not know what "plagiarism" means, especially if they planned to vote for HIM. ;) ) So the side-by-side original at the top, a statement in the middle, and a joke image at the bottom - I think that would make the point.

This is a subject that makes my blood boil!

Alright so I am a Democrat big deal! The McGreevy & Cody administrations have cost me $4,000.00 per year after promising relief...They have got to go, and all their political Idiots!

Corszine scares me also, he a spender for sure! Look at his record.

The only one who has a plan that makes any fiscal sense is Forrester, but he does not have the cash to get elected. Schundler is as bad as McGreevy, he does not even understand the subject matter.

I bought my house in '2002 and my tax bill went from $6,566.00 to $10,200.00 within 4 months. I went to the town, county and finally ended up in a law suit with the State of New Jersey. There was a computation mistake in my assessment and I won (10 x 16 = 160, not 960).

The only thing that will change this is for the local officials to get voted out first, then Trenton. The democrats in Jersey are a bunch of corrupt mob influenced assholes and have dropped the ball, but the republicans don't even understand the issue.

I am screwed either way!

A Dean for President campaign photographer disputes a claim by a web design firm working for Bret Schundler that a photo of Howard Dean doctored to include Schundler was taken by them. The firm's owner had claimed the photo belonged to them.

"It's a photo I took as Dean Campaign staff photographer and I'm waiting for a call back from the lawyers representing Big Fish on how they are going to handle the copyright violation. I own all rights to the image. If they claimed any rights they are seriously off base," John Pettitt told PoliticsNJ.com.

In an e-mail on Wednesday, Schundler's web designer, Tom Frank, told PoliticsNJ.com: "The original photograph is a photograph that Big Fish, as a vendor to Howard Dean's campaign, took at a Dean rally. The second photo image is a photo collage, composed of a well-known image of Bret Schundler superimposed on top of the original crowd shot from the Dean rally."

"When the Schundler campaign was advised by a news organization that a photo image on our website was, in fact, a doctored photo, we ordered our web services vendor to remove it immediately," said Schundler spokesman Bill Pascoe. "We did not ask them to doctor a photo of a Howard Dean rally; we did not authorize them to doctor a photo of a Howard Dean rally; we did not know they had doctored a photo of a Howard Dean rally.

"As anyone who visits the front page of our website can see, Bret Schundler has no difficulty generating crowds of supporters wherever he goes. The amazing thing – and, in fact, the really newsworthy thing – is that Democrats are pushing this “story” as hard as they are.
