Experts say delay of Cali recall will be overturned within days
The decision of the 3 judge panel to delay the election will most likely be overturned and within a few days. (Article also points out that the judges will wish to give the opposing sides time to take the case to the SCOTUS.) I don't think it will go there (but I could be wrong). Both sides hope for a win at the polls October 7th and the conservatives are desperate to not show the Supreme Court to be the partisan body it has become lately. If suddenly the Supreme Court decides that Gore v Bush has no validity anymore because it would help Democrats this time, it will show that the decision in 2000 was just a convenience.

1. my take
Ok as a new US citizen my take on this is that since the californian constitution allows the recall and it must take place within 80 days, and the required signatures were collected, then anyone trying to stop it is pissing in the wind. I might not agree with it, but you play the game you play by the rules agreed prior to playing.

the question they're being asked is "is the statutory limit of 80 days more important than the requirement that the election be fair?"

It's not an invalid question.
