Just heard from friend in Florida that the sheriff blew it and didn't give him Miranda rights. He'll get off death penalty at the least and possibly could walk free.

And Jeb Bush is investigating Shiavo's husband?

Why isn't the media covering this? Too embarrassing for Jeb? Does anyone have a link?

edited to add.. Florida news said the idiot cops didn't even make a tape of his confession.

Confession of rape and murder may not hold up in court

Citrus County, Florida - A confession from the man accused of murdering Jessica Lunsford may not hold up. The prosecutor says a "legal issue" may cause the defense to challenge John Couey's confession. The prosecutor would not elaborate. Couey was arrested in March. Citrus County detectives say he confessed to kidnapping, raping and killing Jessica Lunsford. Couey pleaded not guilty. He's at the Citrus County jail awaiting trial.

While prosecutor Brad King won't say what the legal issue is with Couey's confession, he did say what it was not.

Specifically, King torpedoed a published report claiming Couey wasn't read his Miranda rights. Investigators read Couey his rights as many as five times, King said.

The Citrus County Sheriff's Office confirmed that Couey was read his rights.

The New York Post published a column Monday quoting Jessica's father, Mark Lunsford, saying two prosecutors told him "we may lose this confession because cops neglected to read him his rights. Forget any death penalty, we may even lose the charge of killing my daughter, raping her and burying her alive because of a technicality."

Lunsford was in New York lobbying state legislators to strengthen laws against sex offenders.

He spoke to the Post about his anger toward Couey, Couey's housemates, who were accused but not charged with obstructing the investigation, and local investigators, whom he allegedly called "Keystone Kops."

While some of the column was correct, Lunsford told the St. Petersburg Times on Monday, the part about Miranda rights wasn't.

"It wasn't that they didn't read him his Miranda rights," Lunsford said, but that Couey had asked for an attorney during questioning and investigators kept asking questions.

he asked for attorney and they did stop questions... but came back later and failed to read miranda rights again.

How many times does one have to be read Miranda rights?

23. I don't think so, I live in Citrus County and I have not heard a thing...
about it. Plus the St.Pete Times had an article today that the conviction was all but assured. I'm not saying that you couldn't be right, but I live 10 miles from the spot the crime occurred and I have not heard about it.

25. This has been such a tragedy for our community.........
It's sad on so many levels. Up until a few months ago we didn't even lock the doors. Then Jessie was taken, and the no one and nothing has been the same since. I had never even seen or concerned myself with the sex offenders database, but after all this my husband and I took the time to look it up, and low and behold 2 streets over was a sexual predator. We have a three year old and it's scary. What happened to that little girl is horrid. I can't even bare to think about it.

There are a few people in the community that want him to get out, they want to deal with it themselves. I've never seen people this bloodthirsty in my life, but I can't honestly say that I blame them. He ruined Jessica's life, and he ruined our community.

He's a good person and a hard worker. He blames himself, because he had stayed the night with his girlfriend that night. He still thinks if he would have been home Jes would still be alive today. I don't think so, though. That asshole was clearly waiting for an opportunity to take her, and just would've done it at a later date.
The saddest part is that this is a small town, so there were all kinds of rumors that he did it, or that the grandpa got mad and killed her. The rumors were horrible. What that family has had to bear is awful, on so many different levels.
