Christian Wire: Michael Schiavo 'convicted himself' of wife's murder

WASHINGTON, June 21 /Christian Wire Service/ -- Fr. Frank Pavone, national director of Priests for Life, issued the following statement regarding the choice of words Michael Schiavo used to mark Terri Schindler-Schiavo's headstone:

"Michael said, 'I kept my promise,' and therefore convicts himself of having killed Terri. Moreover, to say that she 'Departed this Earth' on February 25, 1990 illustrates the dualistic philosophy that Schiavo and his attorney Mr. Felos have. That statement shows no regard for the fact that a human person is just as much a body as a soul, and this hyperspiritual way of thinking justifies all kinds of physical violence.

"Such dualism has been condemned by the Catholic Church as a heresy. Any Catholic who does not renounce the kind of thinking demonstrated by Mr. Schiavo has ceased believing as a Catholic."

The “clear and convincing” evidentiary standard was established by the U.S. Supreme Court in Cruzan v. Director, MDH, 497 U.S. 261 (1990). A majority of the Court held that there is a constitutional right to reject artificially provided nutrition and hydration but that the state may require clear and convincing evidence in the case of an incompetent patient that the rejection of nutrition and hydration conforms to the patient’s wishes while competent.

The Supreme Court handed down its ruling in the Cruzan case on June 25, 1990, exactly four months after Terri Schiavo inexplicably collapsed at her home and sustained serious brain damage as a result of a loss of oxgen and blood flow to her brain.
