Got a question on civil suits
I work for a pest control company. Yesterday, we heard from one of the other local companies that the local manager of a national pest control company is telling folks around town that we are being sued and will go out of business. We also got a letter yesterday notifying us of the suit, which we feel is bogus.

My question is, can we use the direct testimony of the individual who was told we were going out of business as evidence that the lawsuit was started to drive us out of business or harm our business? It's the manager's daughter who is suing us, claiming her kids were harmed when we did a termite job on their daycare-we did the job after hours, when no kids were there.

I told my boss to let his lawyers know about this, and really I just want to know if I did the right thing.

1. The lawyer your boss uses
will determine if that is of value as evidence. It's good that you brought this up. I recently went through civil court. I had one of the most respected law offices in the northeast. Most cases that are filed end up settled before trial. And then most of the cases that get started are settled before going to the jury. That is partly because it can be nerve-racking, and people second-guess themselves, and think, "Should I have said that? Or did this?" One thing that is never bad is telling your attorney everything you can think of that might be important. It's always better than not saying something.
