DOJ regulation starts 'mandatory data retention' for ISPs to maintain user data and activity

The DOJ recently issued a regulation, which goes into effect next week, updating the Child Protection and Obscenity Enforcement Act for the Internet age. This law, also simply known as 2257, after its number in the criminal code, requires adult businesses to keep detailed records proving that all the models they use are over the age of 18. Incidentally, these records will also contain the real names of performers, and often their addresses too.

That's why 2257 is a great testing ground for a much broader scheme by the DOJ. This scheme, sometimes called "mandatory data retention," would force all Internet service providers to keep files on everything that people using their services are doing online.

1. I think there is something to be said==this IS a slippery slope--as the
gov. can not seems to help itself from collecting all sorts of information on anyone and everyone.

2. Most adult studios already do this.
Just about every porn movie I've seen has a title card showing how to obtain information on the ages and identities of the people in the movie. I see no problem with requiring this same info for online erotica.

5. The regs already apply online
This law went into effect in 92, and there was a huge courtbattle that stuck a deal in 95. Everyone has been following the same set of rules since then.

The problem is that now they have changed the way the law is being interpreted (changed the rules), and have backdated it to 95.

Really picky little shit like:

All movies have the 2257 notice at the beginning. If a movie has ending credits, the 2257 notice has to now be at the end of the film.

A 2257 notice has to have the full name of the custodian of records. It has to say Dan smith, not D. Smith.

No foreign Id's will be accepted. Every movie made in a foreign country is now illegal.

Secondary producers are now required to keep a copy of the records too. If Comcast shows a movie by Vivid on pay-per-view, Comcast also has have to have a copy of every performers ID, even though the performers are obviously all over 18. This one also greatly effects internet pornographers as most buy their content from other sourcces.

There has been a deal reached and they will not enforce this law against anyone who belongs to the free speech coalition (plantiff in the lawsuit), until after some of these rules are decided by a court.

3. I am not ashamed of what I post here and on the web
It does not bother me that they will track pedophiles on the web and others whose activities are questionable. I have been vilified for helping Andy at various rw websites, it is complete slander and
people should be held accountable for malicious activities.

I am "openly liberal" and proud of it, I am a supporter of DU, Dr. Dean, Raw Story, FreePress, and Brad Blog. They can post my name on the web, I DON'T CARE, and I signed the petition to fire Karl Rove, and I am not ashamed of that either.

I will never be ashamed of being a Democrat no matter what they do, no
matter how much dirt they throw my way, I am a lifelong Democrat and I
am proud of it. And I believe that everyone who is eligible to vote should be able to do so and I believe that NO ONE should have the power to alter votes and invalidate the will of the American People. And I believe that only Congress has the right to declare war and that the president is an elected representative of the people he serves and is bound by the dictates of the Constitution of the United States and International Law. I believe that every American should pay their fair share of the cost of running this country including the wealthy and the U.S. Corporate bodies. I support our troops but I do not condone torture or "pre-emptive" strikes. I support an unbiased media which reports facts not opinions and focuses on meaningful issues that have real consequences in the lives of the American people. And I believe that our government representatives should serve the American people not special interests and that all employees of should be bound by rules of conduct which preclude "gifts of money, lucrative contracts benefiting family members, or other financial incentives" from special interests. And I believe that government officials have a duty to inform the public which they serve of fraud and loss of government monies thru investment schemes.
