What is an activist judge?
I'm listening to KGO radio and the host just said the first question to the Pubs & the Dems who claim they don't want activist judges should be "What do consider an activist judge?"

What do YOU consider an activist judge?

1. To me
it's someone who doesn't judge by the Constitution/Bill of Rights but by their own political beliefs and are biased.

3. I agree with you, but the RW keeps talking about strict constructionists.
I looked that up too. It seems that a strict constructionist believes in reading the exact words of the Constitution, and their opposition believes that a judge has to recognize changes in society and culture and to decide what the founders intention would be in today's circumstances.

6. Pretty much agree Freedom
To me an activist judge is a judge who looks at the case, decides where he wants to end up and then looks for a justification in the law to see how he can get there.

The opposite would be to look at the csae, read the law, and then decide by the law whether you personally agree with where you end up or not.

It's applied by those who don't agree with the decision.

5. An "activists judge" is a judge that makes ruling in which the religious
right of this country disagrees with.

Sort of like an "obstructionists", which is a legislator that disagrees with legislation written up by the far right of the republican party.
