O'Donnell: "All the judges who have seen the prosecutor’s secret evidence

In February, Circuit Judge David Tatel joined his colleagues’ order to Cooper and Miller despite his own, very lonely finding that indeed there is a federal privilege for reporters that can shield them from being compelled to testify to grand juries and give up sources. He based his finding on Rule 501 of the Federal Rules of Evidence, which authorizes federal courts to develop new privileges “in the light of reason and experience.” Tatel actually found that reason and experience “support recognition of a privilege for reporters’ confidential sources.” But Tatel still ordered Cooper and Miller to testify because he found that the privilege had to give way to “the gravity of the suspected crime.”

Judge Tatel’s opinion has eight blank pages in the middle of it where he discusses the secret information the prosecutor has supplied only to the judges to convince them that the testimony he is demanding is worth sending reporters to jail to get. The gravity of the suspected crime is presumably very well developed in those redacted pages. Later, Tatel refers to “aving carefully scrutinized voluminous classified filings.”

Some of us have theorized that the prosecutor may have given up the leak case in favor of a perjury case, but Tatel still refers to it simply as a case “which involves the alleged exposure of a covert agent.” Tatel wrote a 41-page opinion in which he seemed eager to make new law -- a federal reporters’ shield law -- but in the end, he couldn’t bring himself to do it in this particular case. In his final paragraph, he says he “might have” let Cooper and Miller off the hookere the leak at issue in this case less harmful to national security.”

On this side of the pond, the jailing of Ms. Miller was in the news this morning, but I must say without the entire context.

I've always thought our media were more honest, but there has been total silence on the entire election "irregularities" and litlle more than a peep about the DSM, Plame or other "gates".

Not surprising, given their nefarious roles as propagandists for the Bu$h neoconster regime, we now have a bit of drama as to who it was that released Cooper from his pledge of confidence. To wit:

But according to the Washington Post, Rove's attorney, Robert Luskin, told the newspaper Rove was not the source who called Cooper yesterday morning and personally waived the confidentiality agreement.

"Karl has not asked anybody to treat him as a confidential source with regard to this story," Luskin said.

Hash-brained, delusional, traitorous, Bush-worshipping freakazoids, and get the paper back to actually reporting news based on facts it digs up, rather than being a fucking OSP stalking horse.

They need to clean house, from top to bottom if they are ever to gain any credibility. Their current whining about protecting journalists sources is absolutely laughable.

Even as Matthew Cooper of Time and Judith Miller of The New York Times both face prison time for protecting their White House sources, a question arises that the indignant Washington press corps seems to have forgotten to ask: Why hasn't the President of the United States tracked down the officials who leaked the C.I.A. identity of Valerie Plame Wilson, fired them and turned them over to the special prosecutor?

George W. Bush hasn't been obliged to answer that difficult question because the media -- understandably preoccupied by the prosecutorial challenge to the essential practice of shielding sources -- has obscured the central issues of the Wilson case. Observing the media coverage, as the prison gates dramatically swing open, it would be easy to forget the events that led to this confrontation between the two news organizations and prosecutor Patrick Fitzgerald. Those events do not flatter the Bush administration.

For two years, Mr. Cooper and Ms. Miller have protected high-ranking sources who sought to use the news media to punish a real whistle-blower, former Ambassador Joseph C. Wilson III. Those sources, aptly called "nefarious" by Judge David Tatel in his opinion upholding the subpoenas, sought to harm the former ambassador by exposing and smearing his wife, Valerie Plame Wilson.

No doubt the disturbing facts are at last being brought to their attention. The President should require Mr. Rove to own up to his actions, reveal what really happened, and prevent the jailing of the reporters who have felt obliged to protect this nefarious misconduct.

One small matter hindering the President from taking the reasonable action proposed by Mr Conason might just be that Bu$h is as much a member of the "nefarious misconduct" club as Rove.

He's doing it step by step...being careful not to get ahead of the story, but he's definitely onto this thing like a lazar beam. A bunch of pieces are falling into place.

The question is who talked to Cooper and now waived the total confidentiality. Many think it's Rove or Novak. I've suspected it was Miller...this way Miller could be the sole "martyr" that the corporate media is now playing her to be.

Playing the connect the dots game, I suspect Cooper got the initial info from Miller who had gotten it directly from Rove or from someone who got it from Rove. This is like playing telephone. She was the one who told Cooper and Novak...and they called Rove to confirm it. Since it was a deny or not type question, Rove could skirt any criminality...Miller's front is his shield, and her annonymity would protect their connections. Almost the perfect circle.

That is until Fitzgerald got involved. He smelled a lie or something not squaring with the testimony he was getting. Thus the change of focus in this investigation. Who knows what type of tesimony he's taken...the names that could be involved here. No matter, I've seen this man work before and he works methodically, but very efficiently. We might not just get one frog walk, we might get a parade.

Fitzgerald has been incredibly secretive about the case, where it's going, and why he's subpoenaing all these reporters. But being secretive is his job. He's a prosecutor. And federal law is clear that authorities are not allowed to divulge grand jury testimony.

But the witnesses are under no such constraints. It's been reported that Fitzgerald has asked witnesses not to talk about the case in public -- but that has no legal authority.

Prosecutors sometimes legitimately ask grand jury witnesses not to speak publicly so as to not tip off subjects or other witnesses. But Fitzgerald has declared that he is almost at the end of his investigation, and the subjects certainly know who they are by now. So that's pretty much moot.

In fact, the only people not getting tipped off are the members of the public, and it's time that stopped. Why is everyone keeping Fitzgerald's secrets for him? Enough!

For instance, if Cooper and Time are willing to divulge their sources to Fitzgerald, ..... And the New York Times could answer some questions. ... For instance, ... Or is it in their interests to turn Miller into a martyr?

24. The law from 1972
does allow judges to decide if the journalist has a greater need to protect the source, or if the prosecutor needs it because there is no other avenue available to gather the necessary evidence. I think that several of us have been saying this for the past nine months: whistle blowers are afforded protection on an individual, case-by-case basis. This case doesn't have anything to do with protecting whistle blowers.

ARTICLE 1: MURDERS OF SEPTEMBER 11, 2001

That on, before, and after September 11, 2001, George Bush and Richard Cheney, by act or ommission, aided and abetted in the conspiracy to attack the United States of America by:

1) Standing down the security of the United States of America with foreknowledge of an impending attack;

2) Complicity in a conspiracy to remove the Taliban Government of Afghanistan that opposed a joint US/Saudi led Gas Pipeline project through their country, with final negotiations breaking off in June 2001;

3) Conspiring with military, industrial, and energy leaders to create a national tragedy that was considered politically and strategically necessary in order to advance already conceived plans for invading Afghanistan and Iraq, for which in March 2001 the Pentagon had already prepared maps to seize and distribute Iraqi oil and gas assets to favored companies and nation states;

4) Conspiring to create a fraudulent WAR ON TERROR in order to create mass panic, fear, and deception that would lead to an attack upon other nations as well as the intentional dual purpose of beginning to clamp down on the rights, liberties, and dissent of the American people;

5) Obstructing justice by concealing the role of Saudi Arabia and others in the crime and by creating non-public off-shore prison camps in order to conceal the evidence collected and persons arrested that may reveal the full extent of the crime, including the role of the United States, that may have otherwise been made public through public trials, independent civilian legal defense teams, and ordinary defendant communications.

ARTICLE 2: ELECTION FRAUD OF 2000 AND 2004

1) That in the national Presidential elections of 2000 and 2004, George Bush and Richard Cheney, in conspiracy with others, sought to defraud the American people of their votes and their true choice for President and Vice-President, through voter intimidation, suppression, and disenfranchisement;

2) That through the manipulation of voting machines, ballots, and tabulations, votes were misplaced, altered, destroyed, or added through paper or electronic exploitation in order to favor their alleged victory for office;

3) That said actions were conducted in conspiracy with voting machine companies, public election officials, and others who had both a conflict of interest and political agenda to insure the elections of George Bush and Richard Cheney.

ARTICLE 3: WAR CRIMES/CRIMES AGAINST HUMANITY

1) That before, after, and during March 2003, George Bush and Richard Cheney conspired with military, intelligence, industry, and allied national leaders to illegally invade and occupy the nation of Iraq as part of an ongoing criminal conspiracy to exploit the human and natural resources of the world;

2) That said invasion caused the unjustified homicides of tens of thousands of human beings by exploiting fears of the attacks they conspired to permit on September 11, 2001, and using the United States military to advance their criminal aims;

3) That if proven as alleged, that the President and Vice-President aided and abetted in the conspiracy to attack the United States of America on September 11, 2001, by act or ommission, then their complicity in that crime would also transfer their intent and knowledge to commit war crimes and crimes against humanity in Afghanistan, as a victim of those crimes;

4) That said invasion and occupation used banned weapons, weapons of mass destruction, and depleted uranium weapons that maximizes death and injury for years to come;

5) That said occupation is also illegal, as is the use of collective punishment, forced incarceration of civilians, massive military assaults, and the use of a puppet regime and national Iraqi military or police to advance the goals of occupation, all in violation of international war crimes standards;

6) That Congresspersons and Senators who voted to authorize the President with such war powers voted in violation of the Constitution of the United States, in conspiracy with the powers seeking war, and as a result, must also be held accountable for these crimes;

7) That said crimes violated the United Nations Charter, the Nuremburg War Crimes Agreement, Geneva Convention, and other international rules, laws, and regulations regarding the use of force against, and occupation of, a nation;

8) That said war crimes and crimes against humanity are designed to enrich favored contributors, benefactors, family, and friends that are associated with America's Military Industrial Complex and global oil and gas industry;

9) That crimes against humanity are also being perpetrated against the people of Colombia where chemical weapons, under the fraudulent guise of the WAR ON DRUGS, are being used against people, their farms, and communities in order to aid the development and protection of America's oil and gas industry, which dominates the energy market in Colombia;

10) As chief advocate of war, Vice-President Richard Cheney conspired to promote a war that would enrich a company he once ran and still has a vested interest in, Halliburton USA. Regardless of his claims he had no influence in obtaining Iraq war and reconstruction contracts for the company, Richard Cheney, as former Secretary of Defense in 1992 and as Chairman of Halliburton, used his prior offices to position Halliburton to greatly benefit from just such a war. Knowing full well a war with Iraq would result in substantial income and profits for Halliburton by pre-arranged strategic political, military, and contractual positioning.

ARTICLE 4: FINANCIAL CRIMES AGAINST THE PEOPLE

1) That by advancing policies to increase the national debt, provide large tax cuts to the wealthy, and manipulate monetary policy, George Bush and Richard Cheney conspired with business, commerce, and others to create a national economic atmosphere designed to defraud American taxpayers trillions of dollars in funds and social services;

2) That the effort to privatize Social Security is an investment scam that will cost poor and ordinary Americans needed retirement and other security benefits in order to further enrich political contributors and other favored family and friends in the financial, investment, and business community;

3) That the effort to provide a Medicare Drug Benefit was a fraud designed to enrich drug companies and others at the expense of taxpayers, who were provided purposefully false information on the costs and benefits in order to achieve approval of a bill that provides for no negotiation with drug companies on prices, further adding trillions in future debt and further benefiting the drug companies and investors who buy their influence in Congress and at the White House;

4) That efforts to manipulate Social Security and Medicare are part of George Bush's and Richard Cheney's conspircay to defraud the American people of social services in order to compel their privatization in a system designed to enrich favored political contributors, financial benefactors, family and friends to the financial and social detriment of the American people;

5) That by conspiring to permit an attack upon America and plan for both national, Afghanistan and Iraq, and long-term wars, the WAR ON TERROR, George Bush and Richard Cheney conspired to rob the Treasury of the United States in order to benefit the financial position of military defense contractors, energy companies, Saudi Arabia, and other multi-national interests that have favored financial, political, personal, and family ties to George Bush, Richard Cheney, and other co-conspirators associated with them.

PLEASE NOTE:

Since the Articles of Impeachment only demand a trial for removal from office, all allegations may be proven by a preponderance of the evidence, whether direct or circumstantial, which by the great weight and totality of all the proof that is offered, can conclude with a verdict of GUILTY and not require proof beyond a reasonable doubt as in an ordinary criminal trial.

THE ARTICLES OF IMPEACHMENT HAVING BEEN READ, LET THE TRIALS BEGIN!

So does anyone else have a dream...a plan...a scheme?

Special prosecutor Patrick J. Fitzgerald lived up to his billing as a hard-nosed U.S. attorney when he pressed for the jailing of a reporter who refused to testify in his investigation into the leak of a CIA agent's name. But his action just as likely was spurred by the unique fact-finding mission given special prosecutors, legal observers and those who have worked with Fitzgerald in the past said Thursday.

Admired by counter-terrorism agents for his courtroom aggressiveness and photographic recall of facts, Fitzgerald also has been criticized by defense lawyers for harsh tactics.

In taking on the Plame case, Fitzgerald had to understand that "someone's nose would be out of joint no matter what he did," McCarthy said.

In the early 1970s, ex-CIA officer Philip Agee wrote a book and worked with newsletters to expose the identities of CIA officers overseas. Bush hated Agee because, he said, one of the hardest things he had to do as CIA director was meet with Tim Welch and tell him that his father had been murdered.

While the 1st Amendment, political hypocrisy and irony grab our attention, let's not forget where this started. In 1982, in response to Agee and others, Vice President George H.W. Bush helped push through a law making it illegal to knowingly divulge the identity of covert CIA personnel.

President George W. Bush can still talk to his father about the deadly politics of leaks. Tim Welch can't.

Mr Kass also notes that Mr Fitzgerald is doing in DC what he has done in Chicago, "climb the ladder by using the charges of perjury and lying to federal authorities as leverage to further loosen witnesses' tongues."

Mr Kass speculates that that ladder has already gained Mr Fitzgerald entry to the White House, and, interestingly, he mentions Cheney's name as well as Rove's.

The White House just released the transcript of today’s Gaggle.

For the fourth straight time since his lawyer admitted that Rove was one of Matt Cooper’s sources, no member of the White House press corps asked a question about Rove’s role. (And there are plenty of questions to ask.)

A major figure in the White House is deeply entangled in a major scandal. Why is the White House press corps ignoring the story?
