3. Pretty much.
Except that we don't know a whole lot about what Ms. Plame/Mrs. Wilson was doing with the CIA. It's classified, you know...

Not to mention it is part of an ongoing criminal investigation which, everybody knows, no one at DU will comment on...

7. But it applies only to those who are authorized to have the info.
this might be Rove's real defense. The Act applies only to people who learn the identity of a covert agent because they were authroized to know it in the first place. I doubt Rove was authorized to even know that Plame was a covert agent.

I'm not too sure this would apply. Maybe 798(a)(3), however “communication intelligence” is narrowly defined:

(b) "The term “communication intelligence” means all procedures and methods used in the interception of communications and the obtaining of information from such communications by other than the intended recipients;"

Pertinent section says:
"...intentionally discloses
any information identifying such covert agent
to any individual
not authorized to receive classified information..."

One possible loophole for Rove and whoever else leaked could be section 426(4) which defines "covert agent". But it has been mentioned, Plame's activities are probably classified and only the CIA, the prosecutor and maybe the grand jury know.

It seems likely to me that she was covert since the CIA took the complaint to the DOJ.
