1) Liebold claims copyright infringement using DMCA club. Remove infringing material.

2) Clueless attorney tells client, shut down everything, client does.

3) We are fighting to get access to our files in order to set up elsewhere.

As to what kind of case Liebold has, I'm sure that certain other posters will be more than happy to tell you the yarn Liebold will spin.

Why not send them notice rescinding any permission, implied or otherwise, AIT may have to possess BBV copyrighted material, hereafter referred to as the "BBV site", and demand its immediate return, destruction of all copies thereof, and proof of said destruction satisfactory to BBV?

David,

Earlier there was talk on a one to two page summary that would be a good flyer to hand out, and or send to others.

Seems to me now it is a great time for us to begin an Election Reform meetup movement nationwide and keep things moving. I have approached this subject here at DU and I think now with the amount of publicity presently being given, the time is now. It would be great to establish neighborhood walks, etc. There is no reason to sit back now, unless I am missing something.

And in the end, this has little to do with Diebold and more to do with implementing fair elections through a voter verified paper trail and a thorough audit.

Thoughts?

P.S. You might want to place more of an explanation on the website. Its pretty abrupt, and of course this whole thing has been abrupt, but so many have been trying to help, we cant let these others dictate how this is going and what good is taking place. WE ARE RIGHT, THEY ARE WRONG. Americans know it.

8. Shance perhaps you could take the iniative on this
Possibly a good move would be to contact Rush Holt, he has an aide (I don't recall the name) who is active in the electronic voting problem. We need a national image to mount a national movement and Holt may be the place to start. I do agree that we need to have total vote reform.
The HAVA is a huge mistake and was not for the American people (but then what is in this misadmin. It is just another "loot the treasury" scam. This was a double shotgun blast at the people. They not only steal our money, but our vote, as well. What a perfect operation. Sounds Rovian to me.

Along with that I think we all can take the initiative by building up movements through Election Reform Meet-ups via Meet-up.com and that way more people can feel like we are all doing something even more constructive than just sending out emails.

It has to happen along with the "shoe-leather" approach as Governor Dean says.

The meetup idea is a good one. I signed up for the election reform meetup a while back and I think a quorum has not yet been reached. Maybe this month it will be different.

So BBV.org is down for at least 10 days. Bev can and should file the required counter notice to have the site and its content restored, and hopefully seek legal advice as to her next step.

I *KNEW* I heard of AITCOM somewhere - it hosts two notorious spammers.

Do a google for AITCOM and you'll get a numerous spam-related hits and cartooney suits as well.

9. I am trying to get the news out as quick as I can
The phone is ringing constant. So I will post here as I get a chance but keep an eye on bbv.com for the latest news.

Some quick facts:

1) The letter from Bev is from Bev. (aol account and yahoo)
2) The attorney for the server farm told them to lock the entire site in respsonce to Diebold imperial command.
3) To the best of my sources, the files are locked and no one has been given access, including Diebold.
4) We may have found new digs for the site once we break out of the current lock.
5) I have seen "Diebold Defenders" on other sites, specifically the Yahoo message board who sound terribly familiar.

6) Bev has received some nasty and threatening email. (more on this later but we have to file reports and such)

19. Wow. So you can use the DMCA to shut someone down for 10 days with NO...
proof that the material linked infringes copyright. That has GOT to be unconstitutional.

If people are thinking counterstrategies, obviously it would help to have a bunch of ISPs lined up so that you can keep parking your domain name somewhere else each time your ISP gets this DMCA notice. After 10 days you can go back to your original provider who is insulated once having received your counternotice. Then you can stay on-line until a court of law actually hears the arguments and decides on a preliminary injunciton or whatever procedure the plaintiff then alleges.

I guess this is a good thing for web site owners to remember -- keep back-ups of everything on your site so that it's portable in the event that your ISP gets one of these letters. And have a backup ISP (or ISPs) who can hold out for 10 days until you can go back to your first ISP. (Of course, if your material does infringe copyright, you'll have greater damages for having it out there longer, presumably -- always good to talk to a lawyer so you know your pottential liability, and whether this is even a good strategy).

I notice that there are no allegations in that letter that there has been 'stolen' material. (I'm not saying those allegations won't ever come. However, theft and/or coversion are serious matters, and it doesn't look like they've come up yet.)
