Under Democratic presidents (okay, Clinton), communications between government attorneys and folks in the administration were decidedly NOT privileged communications. Ken Starr went all the way to the Eighth Circuit to establish that precedent, and the Supreme Court refused to disturb the ruling.
Now, we hear from the exact same Republicans that suddenly nominee Roberts' work for the government is privileged.
