8-Year-Old Charged For Sexual Conduct With Sitter

(KUTV) SALT LAKE CITY, Utah A mother is upset after a 14-year-old babysitter engaged in sexual conduct with her eight-year-old boy, and the eight-year-old was charged with lewd conduct.

Prosecutors have since dropped the charges against the boy, but his mother is still concerned.

The sexual conduct occurred during a game of truth or dar(sic) while the boy was being watched by the babysitter.

Prosecutors say that, while the babysitter initiated the contact, the young boy was a willing participant.

Look carefully at the judge/prosecutor

This reminds me of a child rape case year ago. A girl of 5 was molested (raped) by an adult male. The judge ruled in favor of the accused, blaming the 5 year old for "asking" for it. He felt her behavior was promiscuous and it was all her doing.

The judge was eventually pulled off the bench.

I wish I could remember more about this case.

Isn't that legally impossible? How can an eight-year-old consent? You can't be willing without consent and vise versa. :eyes:

so yes, I'd say he could be a willing participant, even if his thoughts about it might not be exactly what an older boy, or a man's, would have been. He could easily know it's a 'taboo' at that age, and want to break it, as an act of rebellion and 'being grown up'.

There's no way you can claim - legally - that an eight-year-old was a willing participant sexually. What, are they going to throw the kid in jail for being curious about titties? Who isn't who's never touched them?
