Anybody catch Bork on Cspan this morning? |

I just got the end of it - where he was saying that with O'Conner there were 6 liberals and 3 conservatives. :eyes:
And the caller who called in who was mad because Dean was pointing out that the eminent domain (CT) case was decided by 3 conservatives. She insisted they were all liberals. I wanted to tell her that 3 of the 5 were appointed by Republicans - but the show was over. And Bork sure wasn't going to correct her.
Bork was also saying that the Senate wouldn't be able to find much on Roberts - because Roberts hasn't written/published much like he had - which he felt he had to defend at his hearings.

Part of the problem with the liberal/conservative tag is Bork&Cos. propensity to stake the middle far to the right.
Bork said HE doesn't like the left/right dichotomy - that it is all about whether one is an "originalist" or not. (But he will call conservatives "liberals" anyway).

is genuinely scary. In essense the court has gotten everything wrong since they stopped overturning New Deal legislation sometime in the 1930's (37 or 38, I believe). An originalist believes that many laws passed since then, particularly regulatory laws and welfare laws, are unconstitutional.
In other words, unlike the so-called "activist judges" these judges would completely transform American Institutions and Government. Say goodbye to Social Security, the EPA, OSHA, the FDA and so on and so forth.

and almost became physically ill. Appears obsessed with Ted Kennedy -- obviously still holding a grudge because the Great Senator prevented him from spewing his antiquated views from the Supreme Court.

I had to shut it off. First, Steve Skully goes overboard to bring on stories from the Washington Times (that's a source?) and hasn't met a Democrat bashing story he doesn't like to bring up.
Then comes the two or three Repugnican callers for every Democrat or Independent...and be assured any wingnut talking point not only will be aired, it'll be amplified. Anyone who dares to do the same ranting on the other side is cut short.
Bork's still got that pole up his ass about the '89 confirmation...and his anger and disdain for the judiciary and a majority of the American people is always on display. Thank-you Senator Kennedy and the other Democrats for saving us from having this slimeball on the court!

I agree - that is one thing to be happy about - no Bork on the court.
I'm afraid that Roberts is his pretty protege, however. And they did a lot of thinking since 1989 about how to get someone like Bork who didn't seem like Bork on the court.

Remember, that's what they got instead of Bork. That's what made them change tactics. First, they tried the stealth bit with Souter, and got burned. Then they found Clarence Thomas...thought just on the merits of his skin color they could sneak him through. And those were in far better political times than now.
They want an "empty suit" like Roberts, since a loud mouth like Bork did as much to hurt his nomination (not only his writings, but he was doing talk shows at the time and being a major ass...plus a lot of us remembered him from the Saturday Night surprise...he had it coming!)...so now they look for nominees that look good for the cameras (Ollie North lesson), doesn't say much and it becomes a game of personality (or lack of) vs. his true political and judicial temperment and agenda.

personally I'm not into underwear pink ties but I did like the green color of his suit.
as for Bork, I too turned him off and took the trash downstairs.
