This would hang on whether the recorder (freeper) was an active party in the call.

FCC regulations trump anything. ALL persons must know they are being taped! That's why ALL people who are called by radio stations MUST be told they are on the air or being taped. Even when I was doing telephone interviews of rockers for my fanzine, the first thing I was OBLIGED to say was that I had tape rolling and I would ask if the interviewee was cool with that. Basic broadcaster license stuff. That's Federal law. If only one person needed to know, the one person would be the person doing the recording.
