Under the Texas Hate Crimes Law, wouldn't mowing over crosses

Under the Texas Hate Crimes Law, wouldn't mowing over crosses
that signify the dead soldiers be included? I think we need to make sure this avenue is pursued and that this man is prosecuted fully under the statute.
It defines crimes that are motivated by hatred and prejudice.
The statute reads that the Hate Crime offense information falls into eight index crimes, (paraphrased) including intimidation and vandalism.

But you have to love the irony of this:
"Governor Bush worked against this law and has said that he will not make a decision to sign it until it comes to his desk. In his opposition he has
always said "I've always said all crime is hate crime."

In terms of discussion, though, I'm not sure where this thread could go. I think the responses here would roughly fall into two categories:

"Fuckin' A, Bubba... they should charge it as a hate crime, although I bet they won't"

6. I plan to tell all the right wingers around
that one of their own mowed down the crosses. I'll remind them that even freepers coming to counter protest treated the place with respect and placed American flags there. Ask them if the incident showed how other freepers support the troops.
