Is there some exemption in the law for bigmouth journalists of poor judgment, or the "everybody knew" exception? Because my reading of the law says that anyone who discloses the name of a covert operative is in violation of that law.

Certainly there are First Amendment considerations that need to be balanced out, and it may be that the law is unconstitutional. But until a court of competent jurisdiction makes that ruling, Novakula should be getting his beauty sleep behind some high gray walls somewhere, n'est-ce pas?

My reading parallels yours, but once the U.S. is no longer "taking affirmative measures to conceal such covert agent's intelligence relationship to the United States," then the law no longer applies. So, whoever leaked the information to Novakula is liable under subparagraphs (a) and (b) of the law, and Novakula is liable under subparagraph (c), because at the time he blabbed, Plame's "covert intelligence relationship to the United States" was still a secret. You and I are off the hook, though.
