Charges Dropped against K.C. man who spit tobacco in Jane Fonda's face
Edited on Fri Aug-26-05 07:34 AM by mopaul
she was at a book signing here in k.c. mo. and he spit tobacco juice in her face to protest her protesting the vietnam war 3 decades ago.

i just heard on the local news that the judge in the case dropped charges against the man.

i don't get it, and i don't like it, and i don't have any further details.

i thought that was assault?

anyway, i wish i had a big o' chaw that i could spit into ann coulter's wretched excuse for a face, to make up for it.

not all people in k.c. mo. are such dickheads, believe me.

A Kansas City municipal judge on Thursday dismissed a disorderly conduct case against a Vietnam veteran who spit tobacco juice on Jane Fonda’s face four months ago.

Police cited Michael Dean Smith, 54, of Gladstone after the April 19 incident at Unity Temple on the Plaza, where the actress was signing copies of her memoir.

Smith, who served as a Marine in Vietnam in 1970, said he was expressing his anger at Fonda for her actions opposing the war, particularly a 1972 visit to North Vietnam, where she was photographed at an anti-aircraft battery.

Once the judge dismissed the charge, it became a closed record, prohibiting prosecutors and court officials from commenting on why the case was thrown out. Smith’s attorney also declined to comment Thursday.

1. As tempting as it is, don't stoop to their level.
I would like to know the details on why this was dropped. Interesting.

2. That sounds like a BAD
decision by the judge. I wonder if Ms Fonda said she would not testify against the man and that was why it was dropped? There must be something like that that we don't know about.

12. I'm afraid I would not
have her class. That took some remarkable forgiveness on her part.

6. Well
Maybe start with Hepatitis. There are very good reasons it is illegal to share your bodily fluid with people that are not willingly accepting it.

7. The question is
what do "they" test him for? Everything imaginable? Or do you have just a few specifics in mind?

11. That's a WHOLE lot
of diseases. I'm not sure what the legality of that is. Wonder if Ms Fonda demanded that be done. Perhaps she should have.

15. Would you?
If someone spit in your face what would you do? I would want to know if that person has hepatitis or tuberculosis or any other disease that is spread through saliva.

No I am not insinuating that this man be tested for HIV. I am not Bill Frist ova hea.

23. Good point
I have no idea what their methods are. What do they do to someone charged with rape? Do they have them tested before they are tried or only after a conviction? Maybe they wait to just test the victim? I am not sure.

I just know I would absolutely freak out if someone spit in my face. Gives me the creeps!!

13. If Jane Fonda were a cop
This person would've been charged with a felony. Assaulting someone with bodily fluids is an absolute no no.

21. There was someone here who got 10 years
An already-incarcerated man got an extra 10 years for biting a corrections officer. One of the main sticking points beyond the actual assault was his sharing of spit. Hepatitis C is a major problem in most prisons.

4. They wouldn't dismiss that charge if you did it to a Con!
They would prosecute an outraged liberal to the full extent of the law.
