"SUBCHAPTER IV-A--EMERGENCY ASSISTANCE PROGRAMS

§ 5191. PROCEDURE FOR DECLARATION {Sec. 501}

1. Request and declaration

All requests for a declaration by the President that an emergency exists shall be made by the Governor of the affected State. Such a request shall be based on a finding that the situation is of such severity and magnitude that effective response is beyond the capabilities of the State and the affected local governments and that Federal assistance is necessary. As a part of such request, and as a prerequisite to emergency assistance under this Act, the Governor shall take appropriate action under State law and direct execution of the State's emergency plan. The Governor shall furnish information describing the State and local efforts and resources which have been or will be used to alleviate the emergency, and will define the type and extent of Federal aid required. Based upon such Governor's request, the President may declare that an emergency exists.

2. Certain emergencies involving Federal primary responsibility

The President may exercise any authority vested in him by section 502 or section 503 <42 U.S.C. § 5192 or § 5193> with respect to an emergency when he determines that an emergency exists for which the primary responsibility for response rests with the United States because the emergency involves a subject area for which, under the Constitution or laws of the United States, the United States exercises exclusive or preeminent responsibility and authority. In determining whether or not such an emergency exists, the President shall consult the Governor of any affected State, if practicable. The President's determination may be made without regard to subsection (a).

§ 5192. Federal emergency assistance {Sec. 502}

1. Specified

In any emergency, the President may--

1. direct any Federal agency, with or without reimbursement, to utilize its authorities and the resources granted to it under Federal law (including personnel, equipment, supplies, facilities, and managerial, technical and advisory services) in support of State and local emergency assistance efforts to save lives, protect property and public health and safety, and lessen or avert the threat of a catastrophe;

2. coordinate all disaster relief assistance (including voluntary assistance) provided by Federal agencies, private organizations, and State and local governments;

3. provide technical and advisory assistance to affected State and local governments for--

1. the performance of essential community services;
2. issuance of warnings of risks or hazards;
3. public health and safety information, including dissemination of such information;
4. provision of health and safety measures; and
5. management, control, and reduction of immediate threats to public health and safety;

4. provide emergency assistance through Federal agencies;

5. remove debris in accordance with the terms and conditions of section 407 <42 U.S.C. § 5173>;

6. provide assistance in accordance with section 408 <42 U.S.C. § 5174>; and <(Pub.L. 106-390, § 206(b), October 30, 2000)>

7. assist State and local governments in the distribution of medicine, food, and other consumable supplies, and emergency assistance.

2. General

Whenever the Federal assistance provided under subsection (a) with respect to an emergency is inadequate, the President may also provide assistance with respect to efforts to save lives, protect property and public health and safety, and lessen or avert the threat of a catastrophe.

8. Important information here. This IS the new talking point.
They're already saying that the federal government *couldn't* intervene because it was the governor's show. This slaps that claim down.

10. Why wasn't the national guard in New Orleans right away?
And why wasn't the Convention Center on anyone's radar? I guess I'm wondering who was in charge of what and when.

12. Well, yes But who controlled the national guard on Sunday and Monday?
Some one will ask these questions soon, and I would like the answers, sooner rather than later. This is quite straight forward.

14. My thinking is they were already federalized since they are in Iraq...
the US Government had activated the La. N.G. and sent a portion to Iraq. In normal instances the Gov. can call them out on her own authority as the C-in-C of the states militia forces. While some remained behind the entire force was technically activated, therefor the POTUS had control over them. She did ask for NG assitance, whether that means what NG forces were left in the state or permission to draw from another states forces I don't readily know. I would assume then the Govenors of those states would have to make some agreement to send their state militia.

One department to manage federal emergency response activities; and

The Department would oversee federal government assistance in the domestic disaster preparedness training of first responders and would coordinate the government’s disaster response efforts. FEMA would become a central component of the Department of Homeland Security, and the new Department would administer the grant programs for firefighters, police, and emergency personnel currently managed by FEMA, the Department of Justice, and the Department of Health and Human Services. The Department would also manage such critical response assets as the Nuclear Emergency Search Team (Department of Energy) and the National Pharmaceutical Stockpile (Health and Human Services).
Finally, the Department would integrate the federal interagency emergency response plans into a single,comprehensive, government-wide plan, and ensure that all response personnel have the equipment and
capability to communicate with each other as necessary.

Protecting America’s Critical Infrastructure. The Department would be responsible for comprehensively evaluating the vulnerabilities of America’s critical infrastructure, including food and water systems, agriculture, health systems and emergency services, information and telecommunications, banking and finance, energy (electrical, nuclear, gas and oil, dams), transportation (air, road, rail, ports,
waterways), the chemical and defense industries, postal and shipping entities, and national monuments and icons. Working closely with state and local officials, other federal agencies, and the private sector,the Department would help ensure that proper steps are taken to protect high-risk targets.

State/Local Government & Private Sector Coordination. The Department would consolidate and streamline relations with the federal government for America’s state and local governments. The new
Department would contain an intergovernmental affairs office to coordinate federal homeland security programs with state and local officials. This new Department would give state and local officials one primary contact instead of many when it comes to matters related to training, equipment, planning, and other critical needs such as emergency response.

Non-Homeland Security Functions. The new Department would have a number of functions that are not directly related to securing the homeland against terrorism. For instance, through FEMA, it would be
responsible for mitigating the effects of natural disasters. Through the Coast Guard, it would be responsible for search and rescue and other maritime functions. Several other border functions, such as
drug interdiction operations and naturalization, and would also be performed by the new Department.
