That is from Article 3, Section 3 of the US Constitution. Treason is the only crime defined in the Constitution.

You are entitled to say that many, perhaps even most, members of the Bush regime are incompetent, crooked and even guilty of war crimes and crimes against humanity. But they aren't traitors.
