So what happens when Bush appoints the Chief Justice that will preside |
|
over his own impeachment proceedings? Will Scalia have to recuse himself?

1. I think the Democrats should |
|
block and delay any confirmation for both of those vacancies as long as they can. Also, Dems should not allow Scalia to be appointed Chief Justice because he unconstitutionally interfered in the 2000 Presidential election by singlehandedly stopping the vote "re"count in Florida. In a just world, that would prevent him from EVER holding the seat of Chief Justice, especially if Nero appoints him.
We can function with a 7 member court, if necessary.

2. Scalia will not recuse himself. He has no honor. |

If the 2006 elections are honest (ha! ha! ha!) there may be an impeachment, trial and conviction.
It is a function of how badly the roof caves in and that in turn, depends on how long foreign countries prop us up.
If the foreign governments (who already own this country anyway) kick the timbers in, a trial at the Hague may be possible, but we'll see. China - holder of many of our securities - is not necessarily known for its pristine legal system.
