According to CNN, military will not help with mandatory evac of Nola
and will continue to supply food & water to those who won't leave, effectively, imo, nullifying Mayor Nagin's mandatory evacuation order, since I highly doubt the depleted NOPD would be able to do it alone. One question I have: When referring to "active duty" troops, is Gen. Horne also referring to the National Guard?

NEW ORLEANS, Louisiana (CNN) -- New Orleans' mayor has ordered law enforcement agencies to remove from the city everyone who is not involved in cleaning up after Hurricane Katrina, whether they want to go or not.

But U.S. active duty troops will not be involved, the general in charge of military relief efforts said on Wednesday.

Lt. Gen. Russel Horne told CNN the task of removing people against their will was a law enforcement job and that the military would continue to deliver food and water to the survivors still in the city. (See report on the mayor's order to evacuate the city

First, yes, active duty are anyone in a uniform...National Guard and reserve troops.

I don't think the NOLA Police Department is totally up to the job of clearing out that city. Many have lost everything they've had or haven't had many days off or have suffered from many traumas...and you're asking for those people to go street by street, door to door?

The role of evacuating the city should be done by the National Guard under the direction of the military. The guard is a state militia, thus this is who this job should really fall to, but since the military is providing the logistics, they should honor and support this order.

BTW, where the DHS on this? Isn't this city one major health crisis? Isn't that sufficient reason alone for it to be cleared? Oh, I forgot, it's the poor...they don't contribute to Repugnican campaigns.

4. It's fairly simple.
"Active Duty" troops (i.e. not the National Guard) cannot participate in domestic law enforcement activities. The activities you currently see active-duty troops undertaking in New Orleans are mostly humanitarian in nature (i.e. distributing relief supplies, etc.)

To my knowledge, nobody has ever suggested that active duty military would be involved in forcibly removing residents of New Orleans, or any other police activity whatsoever.

And no, it doesn't nullify Nagin's order, since his order never would have included active-duty military in the first place. It will fall on the National Guard and local and state authorities to do this.

confirming that NG troops are under local authority and can do police work.
