If the courts had mandated it, he would complain it should have been the legislature.
With hsi popularity dropping through the floor, he desperately can not afford to piss off the fundamentalist wing of the Republican party and they could not forgive him coming out :-) in favor of it, much less signing it.

maybe even it was here... That during his campaign he stated that if it came to pass would not veto the will of the people? So he is backpedaling from that now?

represents the 'will of the people', not the current legislature. Of course the legislature is heavily democratic.
