Dear Tim,

A short while ago, I told you what hangs in the balance as we replace Justice Sandra Day O'Connor on the Supreme Court. But now the stakes have risen with the passing of Chief Justice William Rehnquist.

On Wednesday, I joined the friends and loved ones of Chief Justice Rehnquist to honor his memory and his service. Now the Senate Judiciary Committee is preparing to start hearings next Monday on President Bush's nomination of John Roberts, Jr. for Chief Justice of the Supreme Court.

The Chief Justice heads an entire branch of government. We in the Senate have a duty to make sure whoever fills that position understands -- and respects -- the rights of all Americans.

President Bush nominated Judge Roberts for Chief Justice a day after Chief Justice Rehnquist passed away. That left no time for consultation with the Senate. Two lifetime appointments to the Supreme Court amount to a once-in-a-lifetime moment -- one that some see as an opportunity to reshape the Court to fit their narrow political agenda.

Washington needs to rise above that. This is no time for "business as usual." With the victims of Hurricane Katrina in our hearts and prayers -- and the aftermath of the mishandled rescue efforts weighing on the national conscience -- we need President Bush to act as a uniter, not a divider.

There is no crisis, or need for haste. Justice O'Connor plans to stay on the Court until the confirmation of her successor.

These nominations are one of the most important decisions of our time. You've signed the petition, now pass it along -- ask everyone you know to send the message, "The Senate is not a rubber stamp."
