"We have to make sure the tailings won’t cause any problems with water quality downstream," Fogels said. "Essentially, they’re asking to ‘borrow’ the lake for a period of time, and when they’re done, they plan to restore aquatic life there… If that’s all done, there shouldn’t be any problem."
Fogels is the "large mine project manager for the DNR, which coordinates permitting for all state agencies".

This is just horrific that they are using gold prices as their excuse. They did the opposite with logging in the Sequoia's saying it was fire prevention but the judge saw through that because of timber prices and issued an injunction just today.
Your brother needs to sue, or get the AG of Alaska to sue. That's what they did with Sequoia National Monument in California.
