Joe is doing well.

Roberts has just said 'miscegenation' twice. And they are referring to English common law. This is something I have just learned about - never in my life have I heard that English common law had any bearing on our law, beyond how it affected the writing of the original constitution.

Is it just me or should English common law have no bearing on decisions?! It's not like English common law is our common heritage, even! Why should English common law hold any dominion over, say, African-Americans. WTF?!

I don't get C3. Right now Spector is talking off the cuff. They cut in at the end of Kennedy who didn't seem pleased and marched off-something about Warren court. Spector thinks Roberts has answered more questions than most.

11. yes, but he is not very effective and it looks like a put-on act
for his future presidential votes (not from me!) Using bluster against Roberts is not the smartest trick. R. is so smooth, intelligent and articulate (all three a great rarity for conservatives) that people like Biden end up looking bad by comparison. Kennedy was much more effective because he was persistent but relatively calm. Durbin was excellent yesterday too, imho, and so was Feingold. But Biden is acting like a caricature of himself.

He also said that the public has the right to know what any senate or congressman thinks or would do in any situation. But we have a co-equal branch that does not need to answer to the public. All we need to know is that you are a good guy and etc. Biden wanted him to answer as a father or family member whether the family or the courts have the decision on feeding tubes, comatose, etc. Roberts beat around the bush, because some potential case may come up.
