If all the dems vote no it leaves it up to the few reps that have a problem with our first "gay" justice to deny the appointment. I know there are serious problems with this appointment but I feel a filibuster at this time will be wasted and unify the reps. We still have one more fight coming up and will in all likelyhood need all of our energy in one place.

If we filibuster the Republicans bring in Cheney to change the rules of the Senate and then we lose and look impotent and lose the ability to use it in the future....
We need to save the filibuster in case Bush* nominates a nutjob like Janice Rogers Brown to the Supreme Court....
Then we can oppose her with the knowledge we are fulfilling the will of a large majority of Americans...
Roberts couldn't be Borked....
