Remember when Judith Miller said she wouldn't testify even with a waiver?

MILLER: I was not a party to those discussions. I'm going to let you refer those questions to my lawyer. I can only tell you that as soon as I received a personal assurance from the source that I was able to talk to him and talk to the source about my testimony, it was only then and as a result of the special prosecutors' agreement to narrow the focus of the inquiry, to focus on that source, that I was able to testify.

I testified as soon as I could. And I will ask you to please address the questions to which I was not a party to my lawyers.

UNIDENTIFIED FEMALE: But Judy, a conversation you were a party to, on the steps of this courthouse, when you and Matt faced contemptive court charges, you said out here when Matt was asked the same question, your answer was different. You said no waiver would be acceptable.

MILLER: No, I said I had not received a personal explicit voluntary waiver from my source, what I considered that. That was my position, and I said it many times. I said it before I went to jail. I said it when I was in jail.

FRANKEN: What about -- what about the perception that you spent 85 days dancing on the head of a pin?

MILLER: I will let people draw their own conclusions. I know what my conscience would allow. And I was -- I stood fast to that.

What was interesting was that she began shaking while answering that question. You must see a video of it. Her left hand went up to tuck her hair behind her ear, as she had been doing earlier, but this time her hand was visibly shaking. Someone standing behind her reached a hand out and patted her on her back. Very soon after that someone in her posse said that that was the end of questions and they left.

What made her refuse Libby’s waiver when it was first offered but accept it now? (Especially since Judge Hogan had told Miller that “she was mistaken in her belief that she was defending a free press, stressing that the government source she ‘alleges she is protecting’ had already released her from her promise of confidentiality.”)

Was Miller’s sudden eagerness to find a get-out-of-jail excuse prompted by Fitzgerald’s planning to ask for an extension of the grand jury?

Or was it prompted by Fitzgerald’s gearing up to charge her with criminal contempt?

If all it took for Miller to feel properly released was a phone call, why did she wait 85 days to make it?

And so we don’t forget what this story is really about, and given that the aluminum tubes crap that Miller put on the front page of the New York Times was being heavily promoted by Cheney, how much of that bogus information came to Miller via Libby?

And here are a few questions for the Times:

Had a Plame/Wilson story been assigned to Miller or not?

What, if anything, did she say about the story to anyone at the paper at the time… and what did they say back?

Why did the Times hold back the story about Miller’s release and let multiple other news sources scoop them? Were they trying to miss the evening news cycle and avoid the overnight thrashing their spin has rightly received?

So, as the image of Judy as a principled, conscience-driven defender of the First Amendment gives way to the image of Judy wearing her "new" waiver as a fig leaf allowing her to get out and sing, the big question remains: What is she hiding?
