Ok people, get ready, this is the spin, but here's what I see as the REAL story:
Remember when Delay was first indicted? He waived the statute of limitations on the charge of conspiracy. It was a lesser charge than money laundering and there was speculation that he copped a deal. I think that's still operative, only he decided to go BACK on his word. The prosecutor decided to go ahead w/ the more serious charges. The grand jury today was probably presented w/ the ALL THE WORK and EVIDENCE and FINAL REPORT that was all ready to go. THAT'S why it turned in it's verdict so quickly. It was all nicely wrapped up in tight little bow and just waiting for Delay to be the piece of vermin he is and go back on his deal to plead to the lesser charge. Earle struck like a viper.

But I think it's the most likely explanation that would explain the events, including the initial waiver. Why would Delay ever give them that waive unless he copped a plea? He copped a plea so as to not be indicted on money laundering, which can carry a life sentence.

4. He reneged on his plea bargain |
|
and so Earle is coming at him with both barrels. He'll seek prison time, too.
I figure DeLay will spend at least three years behind bars in this one, and it will be in a penintentiary not a jail. He could have gotten off with no time in prison at all.

which means he reneged on his end of the deal. Plus mouthing off about the prosecutor probably didn't help him much.

|

Not right away anyway, it would only become evident in court when he entered his plea. Delay would want it kept as quiet as possible for as long as possible.

10. Plea Bargains are never "announced" |
|
They are made behind closed doors. You only know there was a plea bargain after the plea is entered, and then only by looking at the plea, the potential charges, and the sentence.

I was convinced early on that a deal had been struck. I mean, why else would his lawyer waive? Nothing else makes sense. I hope Delay is shitting his pants right now. Something gives me a feeling reneging wasn't a bright move, Earle wasted no time putting the smack down on that plan. Having your lawyer on talk shows 24 hours a day to attack a DA isn't very bright either. Money Laundering can carry a life term, no? Earle is much brighter that the right wing gives him credit for.

I would think though, if he is found guilty, he won't be walking away without jail time. With that plea, I doubt he would have done any jail time at all. If he's guilty, he'll do time. Yea! Hell, I don't even care if it's a couple years, I just want to see his ass behind bars.

34. This is EXACTLY what I thought when I heard of the new indictments. |
|
I was saying this same thing to my sweetie yesterday (as I did my little happy-dance).
The first indictment makes it clear that Delay had cut a deal; there's really NO other explanation for the statement that he had WAIVED HIS RIGHTS re: the statute of limitations UNDER ADVICE OF COUNSEL.
But part of a "plea bargain" is KEEPING YOUR END OF THE BARGAIN; Delay, arrogant and drunk on his own power, just couldn't bring himself to honor his own WORD.
Then, after breaking the deal, he and his lawyer spend an entire week on national TV SLANDERING the prosecutor they had made the deal with.
Not smart. Not smart at all.
