As Chief White House Counsel -- a job she did not hold when the "Patriot" Act was drafted and passed -- it was her job to support the administration's policy. I don't think that's conclusive of what her views would be as a judge.
If she had held the position of Chief White House Counsel during the drafting and passage of the Act, I would think you could damn her for it because you could fairly assume that she had some role in reviewing and advising about it. At a minimum, we would be entitled to all the documentation of her review and contribution to the Act if she had been Chief White House Counsel when it was drafted.
But Miers was an Assistant to the President and Staff Secretary when the "Patriot" Act was passed so it seems doubtful that she had any role in the matter. Once she assumed the position of Chief White House Counsel, it was already established BushInc policy.
I think Miers can be criticized for 100 reasons, but I don't think her statements about the "Patriot" Act while acting in the course of her employment as Chief White House Counsel are much of a basis for anything except fodder for some pointed questions which the Senators should ask her (which she'll likely refuse to answer).
