Miers or Whomever: The Next Nominee Has GOT to Be Filibustered
It doesn't matter who Bush nominates at this point. With the Fitzgerald investigation going on, Bush should not be allowed to sit a judge until after the indictments are handed down at the very least.

1. dems will approve Bush's get out of jail free nominee, they are not
much good at opposing bush in most cases anyway are they?

O'Connor has agreed to stay on until next replacement. Serves her right to delay her retirement after Bush V Gore.

Dems have nothing important to lose - even if they lose the evetual vote - have shown some spine to reassure the base and make important points before 2006.
