Miers says no one knows if she would ban abortion

WASHINGTON (Reuters) - White House lawyer Harriet Miers told a Democratic senator on Monday no one knows how she would vote on abortion if confirmed to the Supreme Court after a published report suggested she favored outlawing it.

Emerging from a closed-door meeting with Miers, Sen. Charles Schumer (news, bio, voting record) of New York told reporters that Miers told him she had not shared her views on the court's landmark 1973 Roe v. Wade decision that legalized abortion.

"She said, 'Nobody knows my views on Roe v. Wade," Schumer said. "She said, 'No one can speak for me on Roe v. Wade."

If confirmed, Miers would replace retiring Justice Sandra Day O'Connor, a moderate conservative who has been the swing vote on abortion and other controversial social issues on the often bitterly divided court.

Bush's stealth game didn't work this time eh? I think right now were starting to see the beginning of split within the gop between the social conservatives and the fiscal government conservatives.

Well the way that roe v. wade would be overturned, If my supreme court knowledge is sound, is through an appeal that makes its way to the supreme court. Right winger talking heads have alleged that there are several cases making their way through appeals courts that would challenge Roe v. Wade.

I guess the way thats being couched is, she cant prejudge the case that will allow her to express her anti-choice repeal of roe v. wade.

Right? is that the mental stretch we are to accomodate that she dont like abortion, and that she cant say even if she will overturn it since it has to be done via the appeal, and the SC will have to agree to hear the case.
