What if Bush declared Fitzgerald an "enemy combatant?"

What if Bush declared Fitzgerald an "enemy combatant?"

Yeah, this question is a bit tongue in cheek, but what's to stop him? The courts? The congress? The media? The Democrats? Public opinion? Look back over the past 4 1/2 years. Nothing has stopped Bush from doing whatever he wanted to do.

So why can't he just say he has "classified information" that Fitzgerald is an "enemy combatant," the whole investigation is a terrorist plot, and ship Fitzgerald off to Guantanamo?

Anyone care to explain what could be done to prevent this?

Perhaps if they had tried something before now they would have been able to get away with it.
Besides which even if something did happen to Fitzgerald, there is still the grand jury to contend with.

Unlike Bush, Congress critters face re-election. If he did anything so breathtakingly authoritarian, even his own party would have him impeached.
